And that the said City Engineer met at the time and place of meeting specified in the notices and proceeded to laymamt_alteisaid.Haskell_ibad_righe-a£-meq...ae_follmrmt........._._......_. -1- HASKBLL ROAD ALTERATION Beginning at a point on the easterly right-of-way line of Hagan Road'. located 15.00 feet north along said Hagan Mad rlgbt-ofway line from the intersection with the northerly right-of-way line of Haskell Road as originally laid out and accepted by the City Council by Council Order We. 81-240, passed August la, 1981, said point of beginning being at the intersection of the proposed new northerly right-of-way line of Haskell Road; thence North 83- 28' 23" East along a line parallel to the original northerly right-of-way line of Haskell Road for a distance of 87.94 feet to a paint, being the point of curvature of avcurve to the left having a radius of 312.50 feet; thence Alan& said curve foran are distance of 490.46 feet to a point, being the point of tangency with the existing westerly right-of-way line of Haskell Road; thence in a northerly direction along the westerly right-of-way line of Haskell Road North 6° 27' 02" West for a distance of 337.06 feet; South 83° 28' 22" West for a distance of 3.35 feet; and North 6° 27' 02" West for a distance of 316.05 feet to the northerly terminus of Haskell Road as previously laid out; thence continuing along the same course North 6° 27' 02" West for a distance of 101.28 feet to a point, being the paint of curvature of evcurve o the right having a radius of 60.60 feet; thence along said curve forna a idstance of 264.09 feet to a paint, said point being located 5.00feet easterly from, measured at right angles to the existing easterly right-of-way line of Haskell Road, extended; thence South 6° 27' OP East along a line parallel to and 5.00 feet east from the existing easterly right-of-way line of Haskell Mad for a distance of 743.64 feet to a point, being the point of curvature of aconcave t0 the right Having a radius of 387.50 feet; thence along said curve for so c distance of 608.17 feet to a point, being the point 0f tangency n the existing southerly right-of-way line of Haskell Road; thence South 83° 28' 23" West along said southerly right-of-way Sine fox a distance 0f 87.94 feet to the easterly right-of-way line of Hogan Road; thence North 6. 31' 37" West along said easterly right-of-way line of Mena Roadfor a distance of 75.00 feet to the paint of beginning. The above described altered right-of-way of Haskell Mad is more fully shown on a Plan prepared by the lames W. Sewall Company of Old Town entitled "Proposed Haskell Road Alteration Plan for Wal -Hart Stores, Inc., Hogan and Haskell Roads, Bangor, Penobscot County. Maine" dated September 19, 1990 and revised February 13 and 22, 1991, filed in the Penobscot Registry of Deeds in Plan Pile No. 0113-91, identified on said Plan as the total of Parcels P. S: K. N. P. Q. and R. A deed to the relocated portions of the Haskell Mad right-of-way has been conveyed to the City of Bangor by Wal -Hart Stores, Inc. recorded in the Penobscot Registry of Deeds in Volume 4911, Page 280, And the City Engineer proceeded to discontinue the remaining portion of the Haskell Road right-of-way which is no longer required for street purposes, said discontinued portion described as follows: Beginning at a paint on the existing southerly right-of-way line of Haskell Road located North 83° 28' 33" East a distance of 87.94 feet from the Intersection of said southerly right-of-way line with the easterly right-of-way line of Hogan Road, said point of beginning being a point of curvature of a concave curve to the left having a radius of 387.50 feet' -2— thence along said curve e fora a distance of 218.52 feet t a point of intersection with the former northerly right-of-way line of Haskell Road; thence North 83° 28' 23" East along said former northerly right-of-way line of Haskell Road for a distance of 104.94 feet to an angle in said former Haskell Road right-of-way; thence North 6° 27' 02" West along the former rightbfroay line of Haskell Road for a distance of 97.95 feet t the intersection of said line with the continuation of the first described having a radius of 387.50 feet, and being the southeasterly right- of-way line Of thealteredlocation of Haskell Road; thence In a northerly direction along said curve for anc distance of 18284 feet to the inter- action with Me former easterly right-of-way line of Haskell Mad; thence South 6° 27' 02" East along said former easterly Tight -of -way line of Haskell Mad for a distance of 324.94 feet to a point, being the farmer southerly right-of-way line of Haskell Road; thence South 82° 28' 23" West along said former southerly right-of-way line for a distance of 381.98 feet to the point of beginning. Meaning and intending to describe that portion of Haskell Road to be discontinued, identified as Parcels 1-1, L-2 and M as shown on the above - referenced Plan prepared by the James W. Sewall Company._ There met at the time and place set for the hearing Mr. Jahn Flymn, representing Darling's Inc., the owners of the property lying to the south of Haskell Road, and the City Engineer. The City Engineer explained that the altered right-of-way of Haskell Road is intended to accommodate a proposed accessnew to land to the east owned by Wal-Mart Stores, Inc., s well a otheexisting property to the north and west. The City Engineer further Indicated that It would be the intent of the City to deed any interest that it might have t0 that portion of the discontinued right-of-way of Haskell Road identified as Parcels t.-2 and M on said Sewall Plan to Darling's, and to convey any similar interest in Parcel L-1 asshown o said Plan to Wal- Mart Stores, Inc. It is further intended thatWal-Marc Stores. Inc. would also convey to Darling's a parcel identified on said Sewall Plan as Parcell 3-2 Subject to the above described exchange of land, MT. Flynn spoke in favor of the proposed alteration of Haskell Road. Since the new alignment of Haskell Road is c s considered necessary to provide for a redirect access to the existing properties that it ae and baa been previously approved by the Planning Board as part of the Site Development Plan of the land owned by Wal-Mart Stores. Inc., it i8 recom- mended that the altered right-of-way of Haskell Road be accepted a apublic way.
