Commentary:
This portion of Pleasant Street is being discontinued to permit the
construction of the Pleasant Street Parking Lot, which Is part of
the Waterfront Redevelopment Plan previously approved by the Planning
Board. In this respect, it has met Planning Board approval for removal
from the Official City Map. Passage of this Council Order will complete
the discontinuance process.

SUP, WHEREAS, the Waterfront Redevelopment Plan as previously approved
by the Bangor Planning Board proposes the construction of a parking lot in a
portion of the area between South Street and Railroad Street, encompassing most
of the existing right-of-way of Please= Street between South Street and Railroad
Street; and
WHEREAS, said Pleasant Street riaht-of-way is no longer considered necessary
to serve as a public street;
NOW, TBEREFORE, Be It
ORDERED, TRAT the attached report of the City Engineer relative to the
discontinuance of Pleasant Street between South Street and Railroad Street be
and hereby is accepted; and be it further
ORDERED, THAT said portion of the Pleasant Street right-of-vay be discon-
tinued as a public way, and removed from the Official City Map.

And that the said City Engineer met at the time and Place of meeting specified in the notices

Beginning at the intersection of the westerly right-of-way line of Pleasant
Street with the southerly right-of-way line of South Street, said point of inter-
section being 21204 feet east from the easterly right-of-way line of Suspect
Street as measured along said southerly right-of-way line of South Street.
thence South 34* 25' 40" West along said westerly right-ofway, line of
Pleasant Street for a distance of 264.92 feet to the northerly right-ofway,
line of Railroad Street, intersecting said Railroad Street right-of-way line
at a paint located 214.74 feet east from the easterly right-of-way line of
Spooner Street as red along said northerly right-of-way line of Railroad
Street; thence North 88° 31' 40" East along said northerly right-of-way line
of Railroad Street for a distance of ]4.0] feet to the intersection of the
easterly right-of-way line of Pleasant Street; thence. North 34° 25' 40" East
for a distance of 220.99 feet to the intersection of the southerly right-of-
way line of South Street' thence North 55° 05' 29" West for a distance of
60.00 feet to the point of beginning.
Meaning and intending to describe that portion of the 60 -foot wide
right-of-way of Pleasant Street extending between South Street and Railroad
Street as Originally laid out and accepted as a public way by the City of
Bangor on August ), 1883.
There appeared at the time and place set for the hearing Mr. Chip Hutchins,
representing Burgundy Realty True4 the owners
of the property at 20 South Street,
and Mr. Steve. Saliba, representing Saliba'sRug Sales, Inc., the owners of the
property at 2 Pleasant Street, and Sohn Frawley the City Engineer. Both parties
spoke in favor of the project; however, Steve Saliba painted out the problems
of excessive on -street parking on both South Street and Pleasant Street which
complicates a and the City Engineer indicated that the parking situation
is being explored.
Me purpose of the proposed discontinuance is to permit the construction
of a public parking lot in the area between South Street and Railroad Street.
a portion of which would occupy the Pleasant Street right-of-way. The parking
lot construction is part of the Nasser Plan for the redevelopment of the
waterfront area, as previously approved by the City of Bangor Planning Board.
The discontinuance of the right-of-way for street purposes is not considered
to have any significant impact on access to the area by the public, since
Pleasant Street is connected to SummerStreet by South Street, and to Summer
Street and Front Street by May Street. In anearlier telephone conversation
with Mr. Larry Parker of Berry, Dunn. McNeilEe
Parker, o of the property
at 36 Pleasant Street, Mr. Parker indicated that he was in favor of the proposed
discontinuance, provided that South Street could be kept clear of on -street
parking to the extent that two-way traffic could be maintained at all times.
This matter was referred to the Bangor Police Department fore amination and
recommendations as to any formal changes which might need to be made in that
regard.
The Bangor Hydro -Electric Company presently maintains an overhead power
line and poles within that portion of the Pleasant Street right-of-way to be
discontinued; however, arrangements are presently being made by the Bangor
Hydro to relocate the power line.

Since the subject portion of Pleasant Street is not needed to provide
publictr
o the a and since the discontinuance has previously been
ended as part of the Waterfront Redevelopment Plan to permit the con-
struction of the public parking area, it is therefore recommended that said
portion of Pleasant Street be discontinued as a public way under the provisions
of 23 M.R.S.A. 93026, with the retention of a temporary public easement for the
existing Banger Hydro line until such time as the relocation of said line is
completed; otherwise, any remaining interests of the City shall pass to the
abutting property owners to the center of the way, being the City of Bangor
n the west side and Burgundy Realty Trust on the east aide. Burgundy Realty
Trust has previously agreed to release any Interests that they might have
within any portion of the discontinued right-of-way which might be required
to accommodate the parking lot construction, including land for a public
sidewalk along the easterly edge of said parking lot.
It is recommended that Pleasant Street be discontinued a a public way
between SouthStreetand Railroad Street, and that it be removed from the
Official City Map.
