Cowcilman PROCEDURE FOR DECLARATION OF LOCAL EMERGENCY 1. The City Council shall have the authority to declare the existence of a local state of emergency whenever a disaster shall occur affecting lives or property within the City of Bangor, which exceeds the response capacity of existing City service departments, including response capacity available under existing mutual aid agreements between the City and area municipalities or agencies. A declaration under this paragraph shall be by Council Resolution, which shall be published in such manner as the nature of the emergency shall permit. Unless renewed by the City Council, the declaration of emergency shall terminate fourteen (14) days after its adoption. The Council may designate a shorter term. 2. Upon declaration of a local emergency, the City Manager and responding City departments shall be authorized to accept all necessary aid from the State of Maine or its agencies, the United States or its agencies, and the Bine Tree Chapter, American Red Cross, the American National Red Cross, orotherprivate relief agencies. Upon such declaration, the City Manager o n his absence, the City's Agency Director, shall be authorized to make direct requests for assistance, as necessary, to the Penobscot County Emergency Management Agency, the Pine Tree Chapter, American Red Cross, or to the public at large. 3. When a quorum of the City Council is unavailable to issue a declaration of local emergency in sufficient time to respond to a disaster necessitating immediate outside assistance, any of the following City officials may issue a temporary declaration: the Chairman of the City Council, the City Manager{ the City Fire Chief or his designee. A temporary declaration under this paragraph shall remain in force for not more than 96 hours, and may be renewed for an additional 96 hour period if a quorum of the Council remains unavailable at that time. A temporary declaration of local emergency made under this paragraph shall be in the form of an Order over the signature of the authorizing City official. A temporary declaration shall be filed with the City Clerk within 72 hours of issue, unless the nature of the emergency concerned makes such filing impossible.
