HomeMy WebLinkAbout2018-02-12 18-108 Order 02/12/201818-108 02/12/2018 18-108 Legal Order N/A Title, Order Acceptance of Opinion of the Boad of Ethics on the Referral of Councilor Cary Weston and Finding No Violation of the Code of Ethics by Councilor Cary Weston On December 27, 2017, Councilor Weston voluntarily disclosed to the City Council that he had mistakenly stated during a 2017 budget meeting that his firm of Sutherland Weston had no financial relationship with the Greater Bangor Convention and Visitors Bureau, an organization that receives funding from the City of Bangor. On January 8, 2018 the City Council, referred the question of whether Councilor Weston's failure to disclose the financial relationship was an actual or potential violation of the Code of Ethics, to the City of Bangor's Board of Ethics for its consideration pursuant to the ordinances of the City of Bangor. On January 30, 2018, the Board of Ethics met to review relevant written documents and videos, as well as oral testimony and a written statement from Councilor Weston. Upon review of the information and in response to the question submitted by the City Council, The Ethics Committee issued a unanimous opinion that Councilor Weston did not violate the City of Bangor's Code of Ethics. Recommend for passage New Business 02/12/201818-108 CITY OF BANGOR ORDER 02/12/2018 18-108 Perry Acceptance of Opinion of the Boad of Ethics on the Referral of Councilor Cary Weston and Finding No Violation of the Code of Ethics by Councilor Cary Weston WHEREAS, on December 27, 2017, Councilor Weston voluntarily disclosed to the City Council that he had mistakenly stated during a 2017 budget meeting that his firm of Sutherland Weston had no financial relationship with the Greater Bangor Convention and Visitors Bureau, an organization that receives funding from the City of Bangor; and WHEREAS, on January 8, 2018 the City Council, by Council Order 18-085, referred the matter of whether Councilor Weston's failure to disclose the financial relationship between his firm of Sutherland Weston and the Greater Bangor Convention and Visitors Bureau is an actual or potential violation of the Code of Ethics was referred to the City of Bangor's Board of Ethics for its consideration pursuant to the ordinances of the City of Bangor, Chapter 33, Code of Ethics, 33-21; and WHEREAS, the Board of Ethics met, reviewed relevant written documents, viewed relevant videos, and received a written statement and oral testimony from Councilor Weston; and WHEREAS, in response to the question submitted to the Board by the City Council by Council Order 18-085 the Board of Ethics issued a unanimous opinion that Councilor Weston did not violate the City of Bangor's Code of Ethics. Be it Ordered by the City Council of the City of Bangor that, the City Council accepts the unanimous opinion of the Board of Ethics that Councilor Cary Weston did not violate the City of Bangor's Code of Ethics. And be it Further Ordered by the City Council of the City of Bangor that, Councilor Cary Weston did not violate the City of Bangor's Code of Ethics when he had mistakenly stated during a 2017 budget meeting that his firm of Sutherland Weston had no financial relationship with the Greater Bangor Convention and Visitors Bureau. IN CITY COUNCIL FEBRUARY 12, 2018 CO 18-108 COUNCILOR WESTON RAISED THE QUESTION OF HIM HAVING A CONFLICT OF INTEREST WITH THIS ITEM MOTION MADE AND SECONDED THAT COUNCILOR WESTON DID HAVE A CONFLICT OF INTEREST WITH COUNCIL ORDER 18-108 MOTION DOUBTED VOTE: 8-0 COUNCILORS VOTING YES: DAVITT, GRAHAM, NEALLEY, NICHOLS, PERRY, SUPICA, TREMBLE, SPRAGUE COUNCILORS VOTING NO: NONE PASSED COUNCILOR WESTON LEFT THE MEETING MOTION MADE AND SECONDED FOR PASSAGE PASSED COUNCILOR WESTON RETURNED TO THE MEETING CITY CLERK
