CIrlC� 91-299 Item/subject: Authorizing City Manager to Acquire Interest of Robert J. Preble in Property at BAnAir Industrial Park Responsible Department: Legal This Order would authorize acquisition of Robert J. Preble •a one-third interest In a 34,151 square foot parcel constituting portions of Lots Nos. 1 and 2 at BaMir Industrial Park. The parcel includes all of the Hammond Street road frontage of Lot No. 1, plus 120 feet of Lot No. 21a Hammond Street frontage.. The City acquired this parcel for Unpaid taxes in 1972. However, Mr. Preble, who was the record owner of a one-third interest in the parcel at that time, was not served with the Notice of Tax Lien Foreclosure required by statute to extinguish his interest. we have recently ently given that notice and Mr.. Preble has paid the back taxes. Taxes for 1991 and 1992 arecurrently owed. Under the proposed arrangement, Mr. Preble would receive $5,000.00 at closing and an additional $6,000.00, without interest, from the proceeds of any future sale of Lot No. 1 by the City. .By previous agreement with DougandLinda Cardene, owners of Lot No. 2, the Cardenas, would advance $4,200.00 of the amount paid to Mr. Preble at closing. The Cardentes would be reimbursed this amount, without interest, on sale of Lot No. 1. Lots in Bankir Industrial park are currently assessed by the City's Assessors at $1.20 per square foot. Box 729 Ellsworth, Maine 04605 Re: Robert J 'Preble - Hammond Street Property Dear Patrick: I discussed this matter last night with the City Council's Community and Economic Development Committee. The Committee members indicated they would favor City acquisition of Mr. Preble'sone-third interest in the Hammond Street property for a total price of $11,000.00, which would not include forgiveness of past -due City of Bangor property taxes. We would be prepared to pay Mr. Preble $5,000.00 of this amount at closing, with the $6,000.00 balance to be paid, without interest, at such time as Lot No. 1 in BanAir Industrial Park is sold by the City. If you will send m written offer to sell Mr. Preble's interest on the above terms, and provided past -due property taxes and interest in the amount of $1,650.41 have been paid by July 12th, I will place the matter on the Council's agenda for approval at its next regular meeting on Monday, July 22nd.
