Commentary:
The final survey of Burgundy Realty Trust's Front Street
property disclosed that the existiAg building renovated by
Burgundy, currently encroaches 0.2 inches into Pleasant Street.
In an abundance of caution, Burgundy has asked the City to
execute an Easement Deed authorizing Burgundy to maintain
the encroachment. The Deed also would grant Burgundy a
easement to eStreet for he fcotpurpose
wide sectioning,Front Street ------
and Pleasant and
set for the purpose of repairing, rebuilding, -
wouldfining and servicing Burgundy's building. This easement
ores survive the city's planned discontinuance of Pleasant
Street.

OHDEMD.
THR the City Manager is hereby authorized and directed
to execute a certain Easement Deed from the City of Bangor
to Christopher Hutchins, Trustee. of Burgundy Realty Trust,
conveying to Burgundy Realty Trust the right to encroach
not more than one foot onto Pleasant Street, and other rights,
said Easement Deed being on file in the office of the City
Clerk.

EASEMENT DEED
The CITY OF BANGOR, a body corporate, located at Bangor,
Penobscot County, Maine, for consideration paid, releases to
CHRISTOPHER HUTCHINS, Trustee of Burgundy Realty Trust under
Declaration of Trust dated July 1, 1988 and recorded in the Penobscot
Registry of Deeds in Volume 4286, Page 209, an easement far purposes
of maintaining, using and occupying the Grantee's building located on
its premises as described in the Penobscot Registry of Deeds, Volume
4502, Page 38, as said building is situated as Of September 20, 1990,
recognizing that said building encroaches over the westerly boundary
line of said premises and onto Pleasant Street, so-called, said
encroachment being a maximum of one foot.
The purpose of this Easement Deed is to recognize that the
building of the Grantee encroaches Over the Grantee's boundary line
and to provide to the Grantee the right to maintain the building on
Grantee's premises -with such encroachment, perpetually.
Grantor further grants to Grantee a perpetual easement to
enter upon land of Grantor, being Front Street and/or Pleasant
Street, for a distance of twenty (20) feet from the Grantee's
property line, with men, equipment, staging, fixtures, and machinery
for purposes of repairing, rebuilding, maintaining and servicing
building.
IN WITNESS WHEREOF, the CITY OF BANGOR has caused this Deed
to be signed and sealed in its corporate name by Edward A. Barrett,
its City Manager, hereunto duly authorized, this day of July,
1991.
