RE: Leo A. Daly Contract Modifications, BIA Renovations/Expansion
The attachedcoespondence and information, outline contract
modifications to our contract with Leo A. Daly. The changes were
necessary afterwe ncreased the scope of the renovation/expansion
project. in addition to the increased scope the changes also include
the costs associated with Ahe value engineering review and the
recommended value engineering design changes.
The FAA haerwed these changes and has given their
approval for all the proposed changes including a verbal approval of
the increased value engineering costs.
The cost changes are as follows:

A more detailed explanation of each of the components of the
'No.,sed scope of services is outlined in the attached "Modification
a l".
You will note that the final amounts for Addition Special
'Services and Reimbursable Expenses are less ($26,819) than the
amounts approved by the FAA. These reduced amounts were the result
of continued negotiation with Daly after I had submitted our
request
for FAA participation in the design costs. You should also note that
the value Engineering Redesign costs were higher ($26,853) than
originally estimated. (The FAA does provide a 15% funding leeway in
approved costa vs. actual costs of an AIP project)'.
These design/engineering costs will be funded using the same
formulaasconstruction onstruction oat reimbursement which is 758 of all
"public" space. we estimate that approximately 658 of the
construction will be categorized as "public".
This contract modification must be approved by the Council
after review by the Finance Committee.

Avenue, N.H., Tenth Floor, Washington, D.C. 30036 (Hereinafter. the Architect) is
modified as followa:
Article 3.4.16.— Shall be modified�to read as followea -
3.4.16 Preparing a met of reproducible record drawings Showing
significant changes in the Work made during Construction based o
marked -up prints, drawings and other data furnished by the Contractor to
the Architect.
Article 11.3.1 - Shall be modified to read am follows:
11.1.1 For Basic services, am described in Article 2, and any other
services included in Article 12 as part of Basic Services, Basic
Compensation Shall be computed as follows:

Article 11.3.1 - Shall be modified to read as follows:

Article 11.1.8 - Computation of Public vs. Nan-Wblic Space for the FAM
LaMeide Development Program. Performing a study to classify spaces
which are in the Phase I scope of work into public -use and non-public
areas,use in accordance with the eligibility regulations of this
programma it applies to both now conatruction and renovation.

Compensation shall be a stipulated sum of Three Thousand Nine Hundred
Sixty Dollars .($3,960.00).
Article 12.1.9 - Providing Schematic Design and Design Development for
Phase Ii. The programming study identified future building options,
which would require detailed revisions in the construction documents
prepared for Phase I. Thede are,
a partial third floor on the West side
of the domestic terminal and a expanded Sterile Hold Lounge on the
Second floor of the international terminal. For the domestic terminal
third floor addition, architectural design shall be carried to a level
defining Plan dimensions, structural section, and building enclosure.
Vertical transportation and fire exiting ayatems. The third floor
space, planned to include arestaurant, cocktail lounge, and observation
lounge, has Special plumbing and mechanical requirements which must be
provided for as well as Public rest r In addition to designing the
Structural system toaccommodate future additions, the building -
enclosure shall be designed to Minimize the Impact of future
construction on the metal panel system.
Compensation shall be a stipulated sum of Sixty -Five Thousand Three
Hundred Forty Dollars ($65,340.00),
Article 12.1.10 - Providing Construction Documents for Phase II options
which must be Constructed in Phase I. Structural, mechanical, and
architectural provision, for the building option, listed in Article
12.1.9 moat be provided in Phase 3. The additional services identified
provide the design and c n,truction documentation necessary to construct
these "infra -structure, which allow the prions to be
eeonomacally constructed inPhaseI.
Compensation shall be a stipulated sum of Thirty -Six thousand Three
Hundred Dollar, ($36,300.00).
Article 12.1.11 - Preparing documentation for the Value engineer to
Perform his review. Preparing for and providing a presentation to the
Value Engineer an the project. Attending the VE presentation.

We have reviewed the fees for the proposed contract between
the City of Bangor and Leo A. Daly Company of Chantilly,
Virginia for architectural and engineering services in
connection with the terminal buildings renovation and
expansion at the Bangor International Airport under a
proposed £Y 91 construction project. we have also reviewed
your letter of February 8, 1991 and subsequent
correspondence (fax) of February. 15, 1991, which further.
clarified the required engineering services with their
associated fees.
Based on our review, we have approved the proposed fee

changed the fee to a actual cost plus fixed fee" since
"cost plus a percentage of cost" method of contractingfor
engineering services is prohibited under airport grant
programs.

acopy of the complete contract for our
review. Ensure that the completed contract is in accordance
with the requirements of AC 150/5100-14E, "Architectural,
Engineering and. PlanningConsultant Services for Airport'
Grant Projects," and that it contains the required Title VI
Assurances. ,.
We also need a breakout of the resident inspection costs. A
of the person selected to be the resident inspector
must mbe: submitted for approval.

sponsor certification forms (attachments 1 thru 5(, I have
