Item/Subject: Authorising the City Manager to execute an amendment to
a lease with BanAir Corporation

The amendment to the lease existing between the City and BanAir for
Building #271 which houses the Foreign Trade Zone #58 and the Business
Incubator would be amended as follows:
A. The lease rate would change from 75 cents per square toot to 75
cents or 658 of gross rent, whichever is greater.
B. It will define maintenance and repair responsibilities as follows:
(a) BanAir - minor interior maintenance up to a $500 limit
(b) Airport - major nalntenance
C. 7t makes the Airport responsible for all utilities. Currently, the
lease calls for Bansir to pay the airport 50 cents per square foot of
occupied apace.

THAT the City Manager is hereby authorized and directed,
n behalf of the City of Bangor, to execute an amendment to a
lease, a copy of which is n file in the office of the City
Clerk, with Bangor CivicAirport Development Corporation (BanAir)
for Building 6271, Johnson and Florida Avenues, Bangor Inter-
national Airport.

Street, Bangor, Maine (hereinafter sometimes
referred to as "Lessor")

(BANAIR), a body corporate, duly organized
and existing under and by virtue of the laws
of the State of Maine, and having a place of
business at 73 Harlow St. in said Bangor,
County of Penobscot, State of Maine
(hereinafter sometimes referred to as

W I T N H S S E T H:
WHEREAS, the City of Bangor is the own of a airport
commonly known as -Bangor International Airport'.owner

as Dow Air Force Base, and located in the City of Bangor, County
of Penobscot, State of Maine (hereinafter sometimes referred to
as the -Airport-); and
WHEREAS, by Indenture of Lease, dated February, 1982,
the parties agreed to lease by the Lessor Building #271 antl the
land appurtenant thereto and other lands and facilities as
described in Exhibit A of that Indenture to Lease; and
WHEREAS, the parties hereto wish to amend said
Indenture of Lease to amend: the rental rate, maintenance
responsibilities, and utility compensation;
NOW, THEREFORE, the parties do mutually agree that the
Indenture to Lease dated February, 1982 be and hereby is
amended as follows,

1). Article III, paragraph (A) will be deleted and the following
inserted in its place.
ARTICLE III
RENTAL
(A) The basic rent for space to be paid by Lessee to
