Commentary: Thin Order would adjust claime of lattice Central Railroad arising
out of the City's acquisition of the Railroad's lower Broad Street lot.
(City Tax Map'42, lot 222). The proposed adjustment is at the Rallotad's
request. The effect Of this Order is that the Railroad would trade its .interest
in the lower Broad Street property for City payment of the Railroad's share of
the Boaz, Inc. Bangor Waterfront Marketing Study. The Railroad also would recei
back a portion of the property acquired in order to widen its east®ent9 per C.O. +
91- 9 also pending on the Couacil's'egeods.
Under the proposed arrangement, the City's anticipated coat to acquire eud clear
J title to the lower Broad Street lot and to pay for. the Bang Inc. Bangor Water-
front Marketing Study would increase from $55r698.00 to $55900.00. This
figure done not include the value of the 49629 square feet area to be conveyed
✓ back to the Railroed9 which would be conveyed to the Railroad at no cost.

ORDERED.
THAT WHEREAS, By Council Order 91-114, passed March 13,
1991, the City Council authorised final acquisition by eminent
domain of property of Maine Central Railroad and others located on
lower Broad Street in the City of Bangor (City Tax Map 42, Lot
222); and
WHEREAS, Maine Central Railroad is entitled to
payment of $32,558.00 from the City az and for damages on account
of said taking; ($33,000.00 as specified C.O. 91-115 passed March
13, 1991); and
WHEREAS, By Council Order 91- passed concurrently
with this Order, the City Council has authorized conveyance back
to Milne Central Railroad of 4,629 squarz£eet of the area thus
acquired; and
WHEREAS, by Council Order 90-169 passed April 23,
1990, and subsequent Finance Committee action, the City Council
authorized the Director of Community and Economic Development to
pay 304 ($14,100.00) of the cost of a joint proposed City -Maine
Central Railroad Bangor Waterfront Marketing Study to be prepared
by Lugger McCall, Inc. (now Bona, Inc.);
ROW, THEREFORE, By the City Council of the City of
Bangor be it Ordered,
THAT, as an adjustment of Maine Central Railroad's
damage claims against the City of Bangor arising out of the City's
taking of the above-described lower Broad Street lot, the Director
of Community and Economic Development is hereby authorized to pay
the full coat ($41,000.00) of the Bonz, Inc. Bangor Waterfront
Marketing Study upon the City's receipt of a release from Maine
Central Railroad of all MCRR damage claims arising out of the
City's acquisition of the above described lower Broad Street lot.
