The attached Council Order relates to the City's recent
acquisition, by eminent domain, of property of Maine Central Railroad
and others off lower Broad Street, par Council Order 91-114, passed on
March 13, 1991.
The City's eminent domain action will result in acquisition of all
of Lot 222, thus extinguishing fee and reversionary interests now
existing under a 999 -year lease from JamesS. Rowe and others to
European 6 North American Railway Co. recorded at the Penobscot
Registry in August, 1881. UNA is Maine Central's predecessor in
title.
The attached Order, at Maine Central Railread's request, would
authorize conveyance back to MCRR a portion of Lot 222 sufficient to
expand the existing fee -owned railroad right-of-way to 50 feet in
width. MCRR presently owns a 25 -foot right-of-way in fee. A separate
Council Order pending on the Council's agendaaddresses the financial
aspects of this conveyance.

ORDERED,
THAT WR9RBAS, by Council Order 91-114, passed on March 13,
1991, the City Council authorised acquisition by eminent domain
for Community Development purposes, of land of Maine Central
Railroad and others on Lower Broad Street adjacent to the
Eenduskeag Stream Bridge (Bangor City Tax Map 42, Lot 222); and
WHEREAS, a portion of said land to be acquired is
surplus to the City's requirements,
NOW, THEREFORE, by the City Council of the City of
Bangor be it Ordered,
THAT the City Manager is hereby authorised to execute
a Municipal Quitclaim Deed conveying 4629 square feet of land on
either side of the existing Maine Central Railroad right-of-way
across said property, to Maine Central Railroad, for the purpose
of widening the existing railroad right-of-way. -

Two lots or parcels of land in the City of Bangor,
County of Penobscot and State of Maine adjacent to
the Kenduskeag Stream Railroad Bridge, more
particularly described as follows:
Parcel No. 1
BEGINNING at the intersection of the easterly
sideline of Broad Street in said Bangor with the
northerly sideline of the existing Maine Central
Railroad right-of-way, said intersection being at a
Point 187 feet, more or leas, from the westerly
footing of the Kenduskeag Stream Railroad Bridge as
measured along said northerly sideline;
Thence with the easterly sideline of Broad Street N
190 07. 23" E a distance of 15 feet, more or less,
to a point on said easterly sideline 25 feet
distant, at right angles, from the baseline of the
existing Maine Central Railroad right-of-way;
Thence easterly parallel to and 25 feet distant
from the baseline of the existing Maine Central
Railroad right-of-way a distance of 145 feet, more
or less, to a point;
Thence northerly at right angles to said baseline a
distance of ten feet;
Thence easterly parallel to and 35 feet distant
from said baseline a distance of 30 feet, more or
leas, to the easterly line of the Kenduskeag
Stream;
Thence southerly with the westerly line of the
Eenduakeag Stream a distance of 1S feet, more or
less, to the westerly footing of the Kenduskeag
Stream Railroad Bridge;
Thence westerly within the northerly sideline of
the existing Maine Central Railroad right-of-way,
said northerly sideline running parallel to and
19.23 feet, more or less, north of the baseline of
the existing Maine Central Railroad right -o£ -way, a
distance of 187 feet, more or lees, to the -place of
BEGINNING; -
Ming portions of the several premises described in
Volume 384, Page 531 and Volume 390, Page 68,
Penobscot Registry of Deede and in Volume 524, Page
259, Penobscot Registry of Deeds, and containing
1513 square feet in area, more or less, said
premises being depicted as 'Parcel B" on a Plan
prepared by the Bangor City Engineer's Office, to
be recorded herewith.
BEGINNING at the intersection of the easterly line
of the City of Bangor "Ferry Slip" property,
so-called, with the southerly sideline of the
existing Maine Central Railroad right-of-way, said
intersection being within the travelled portion of
Front Street, as the same now exists, at a point
181 feet more or less from the westerly footing of
the Nenduskeag Stream Railroad Bridge as measured
along said southerly sideline; and being located
near Station 12+95 on the baseline of said Maine
Central Railroad right-of-way;
Thence with the southerly sideline of said Maine
Central Railroad right-of-way easterly a distance
of 181 feet, more or less, to the westerly footing
of the Eenduskeag Stream Railroad Bridge; said
southerly sideline running parallel to and 5.52
feet, more r lase, distant from the baseline of
said Maine Central Railroad right-of-way;
Thence southwesterly with the westerly line of the
Renduskeag Stream a distance of 35 feet, more or
leas, to a point 25 feet distant, at right angles,
from said Maine Central Railroad baseline;
Thence westerly, parallel to and 25 feet distant
Prom said baseline, a distance of 150 feet, more or
less to a point on the easterly line of the "Ferry
Slip' property, so-called;
Thence with the easterly line of the "Perry Slip"
property N 670 22' 37' W a distance of 22feet,
more or less, to the place of BEGINNING;
Being a portion of the premises described in a
Lange from James S. Rowe at als to The European aM
North American Railway dated August 18, 1881 and
recorded in Volume 524, Page 259, Penobscot
Registry of Deeds, and containing 3116 square feet
in area, more or less, said promisee being depicted
as "Parcel B" on a Plan prepared by the Bangor City
Engineerings Office, to be recorded herewith.
Bearings given in the above two parcel descriptions
are referenced to Grid North.
Both the above parcels being portions of land
acquired by the City of Bangor from Maine Central
Railroad and others by eminent domain pursuant to
30-A M.R.6.A. 5 5204, on or after Narch 13, 1991,
said taking to be recorded with this conveyance.
