B WLVHB, THAT, WHEREAS, Wal -Hart Stores, Inc. is preparing to begin the construction of anew retail facility on property located east of Hogan Road and south of Interstate Highway I-95, the Site Plan for which has been previously approved by the Bangor Planning Board, with similar approval by the Maine DEP pending; and WHEREAS, the development plan as proposed would require the alteration of a portion of the Haskell Road right -of -Way extending east from Hogan Road to said Wal-Mart property, as shown on a Plan prepared by the James W. Sewell Company of Old Town entitled 'Proposed Haskell Road Alteration Plan for Wal-Mart Stores, Inc., Hogan and Haskell Roads, Bangor, Penobscot County, Maine" revised February 22, 1991; and WHEREAS, the City staff has reviewed and approved the proposed alteration of the Haskell Road right-of-way as shown oa said Plan; NOW, THEREFORE, Be It RESOLVED, By the City Council of the City of Bangor. that the proposed alteration of the Haskell Road right-of-way is acceptable; and be it further RESOLVED, that the City Council of the City of Bangor will direct the City Engineer to proceed with the alteration of said Haskell Road right-of-way 1n accordance with State law a such time a all necessary approvals have been received by Wal-Mart and construction of the project is underway. with the understanding that the relocated portion of Haskell Head will be constructed at Wal -Mart's expense to acceptable City standards, under the supervision of the City Engineer.
