CHAPTER III
AETICLB 6 - PARKING

THAT, effective May 1, 1991, the provisions of Chapter Ili, article
6, Sections i through 14, and article.), Sections 1 through l are
repealed and replaced with the following, provided that such
provisions shall remain in full force and effect for the trial and
punishment of all violations incurred prior to May 1, 1991.
CHAPTER III
ARTICLE 6 - PARKING
Sec. 1 Vehicle Parking. Except when necessary in obedience to
traffic regulations, traffic signs or
signals, or at the specific direction of a law enforce-
ment officer, it shall be unlawful and a violation of
this Article for any person,
1.1 Positioning of Vehicle. To stop, stand or park a
vehicle in a roadway other than
parallel with the edge of the roadway, headed in the
direction of traffic and with "a curb side wheels of
the vehicle within six inches of the edge of the road-
. way, except upon those streets which have been marked
or signed for angle parking.
1.2 Parking Vehicles Unattended. To allow a vehicle to
stand on a street
unattended, without first setting the brakes thereon
and stopping the motor of said vehicle, and when
standing upon a perceptible grade, without turning the
front wheels of such vehicle to the curb or to the side
of the street or highway.

1.3
Parking within an Individual Parking Space. To Park a-
vehicle so
that such vehicle is not entirely within an individual
parking space specified and marked off.
1.4
Downtown Parking Management Area. Parking in all
areas shown o
a plan entitled 'Downtown Parking Management District",
dated-aae�� P 1991, shall be regulated as shown on
,
said plan, la copy of which shall he maintained in the
office of the City Clerk and is made a part hereof.
Sec. 2 On
Street Parking - Parking Prohibited At All Times. It
shall
be unlawful and in violation of this Article for any person:
2.1
Parking Prohibited Near Intersections. To stop, stand
opark a
vehicle in a roadway within fifteen (15) feet of any
intersection.
2.2
Parking Prohibited Near Fire Hydrants. To stop, stand
or Park along
the side line of any traveled way, any vehicle, either
occupied or not, within twelve (12) feet of any fire
hydrant.
2.3
Parking Prohibited in Driveways. Sidewalks and
Esplanades. To stop, stand or Park a vehicle so as
to interfere with or hinder the ingress
or agrees to and from a driveway in the City of Margot;
or to stop, stand or park a vehicle on any portion or
part of a public sidewalk or esplanade.
2.4
Parking Prohibited At All Times - Schedule 1. In
addition
to the foregoing Subsections 2.1 through 2.3, to stop,
stand or Park a vehicle on the streets or portions of
streets duly marked or posted, and which are described
or specified in Schedule I.
Sec. 3 On-Street Parking - Parking Prohibited except for Limited
Times. It shall be unlawful and in violation of this
Article for any person:
3.1
Parking Limited to 30 Minutes - Schedule iI. To stop,
stand or
park a vehicle for more than 30 minutes between the
hours of 8:00 A.M. and 5:00 P.M., except on Saturdays,
Sundays and Holidays when such parking may be permitted,
on those streets or portions of streets described or
specified in Schedule II.

3.2 Parking Limited to One Hour - Schedule III. To stop,
stand o
park a vehicle for more than one (1) hour between the
hours of 8:00 A.M. and 5:00 P.M., except on Saturdays,
Sundays and Holidays when such parking may be permitted,
n those streets or portions of streets duly marked o
Posted and which are described or specified in Schedule
III.
3.3 Parking Limited to Two Hours - Schedule IV. To stop,
stand or
park a vehicle for more than two (2) hours between the
hours of 5:00 A.M. and 5:00 P.M., except on Saturdays,
Sundays and Holidays when such parking slay be permitted,
n those streets or portions of streets duly marked or
posted and which are described or specified in Schedule
IV.
Sec. 4 an -Street Parkin - Parkin Prohibited Hxceot for Oeaianated
Uses. It shall be unlawful and in violation of this Article
for any person:
4.1 Parkin Prohibited Extent Loading and Unloading for
Commercial Uses and Taxicabs - Schedule V. To stop,
stand or
park a vehicle for any purpose or length of time, other
than for the expeditious unloading and delivery or pick-
up and loading of passengers or freight for a taxicab or
commercial vehicle, within any of the spaces duly marked
or posted and described or specified in Schedule V.
4.2 parking for Handicaoved - Schedule Vi. To atop, stand
or park any
vehicle not displaying a valid handicapped license plate
or placard issued under 29 M.R.S.A. S 252, or a similar
plate issued by another State on those streets or
portions of parking areas duly posted and which are
described or specified in Schedule VI.
Parking areas designated under Schedule VI shall also
be subject to the time and manner of parking and fees
as my be established under this ordinance from time
to time.
4.3 Parking for Police ehi 1 only - Schedule VIZ. To
atop,
stand or park any vehicle, other than a municipally -
owned police vehicle on those streets or portions of
streets, or in those portions of parking areas duly
posted and which are described or specified in Schedule
VII.

4.4 Parking for Busses only - Schedule VIII. To stop,
stand or
park any vehicle other than a bus, on those streets
or portions of streets or in those portions of
parking areas duly posted and which are described or
specified in Schedule VIII.
4.5 Parkins for Rental Vehicles - Schedule IX. To stop,
stand or
park any vehicle, other than a vehicle belonging to a
ental car agency having a place of business at Bangor
International Airport on those streets or portions of
streets or in those portions of parking areas located at
said Airport duly posted and which are described or
specified in Schedule IX.
Sec. 5 off -Street Parking. It is hereby declared to be a policy
of the City of Bangor to provide for
off-street parking.
5.1 Off -Street Parking cots Established - Schedule X. Off-
street
parking lots and the conditions under which they shall
be operated are hereby established at those locations
described in Schedule X.
5.2 Violations. It shall be unlawful and in violation of
this Section for any person to:
5.2.1 Cause, allow, permit or suffer any vehicle
registered in the name of, or operated by
such person, to be parked within any
established off-street parking area within
the City in violation of the operation
conditions for said lot, said operation
conditions to be established from tLse to time
by the City Manager and posted at the entrance
to each off-street parking area.
Sec. 6 MisceUaneoua P - on -Street and Off -Street Brass.
6.1 Wintertime Parking. It shall be unlawful and in
violation of this Article between
November 1 and March 31 of each calendar year, for any
person:
6.1.1 Night-time Parking Prohibited. To stop, stand or
park or allow to
remain, a vehicle in or upon any public way as
defined in 17-A M.R.S.A. S 505, public square, or

on -street or off-street public parking area
with-
in the City of Bangor between the hours of 12:00
midnight and 6:00 A.M., Eastern Standard Time or
.Eastern Daylight Tim, as may then be in effect.
(a) Exceptions. Notwithstanding the provisions
of Subsection 6.1 above,
parking will be permitted beyond the hours
of 12:00 midnight, Eastern Standard Time or
Eastern Daylight Time, as may then be in.
effect as follows:
(1) On a regular basis at such times, days
of the weeks, special terms and conditions,
and locations as may be established in
Schedule XI.
(2). On a temporary basis for special events,
meetings or functions at such times, dates,
special terms and conditions, and locations
as may be authorised by special permit issued
by the Chief of Police.
6.1.2 Alternate -Side Parking in Daytime. To stop,
stand or
park, or allow to remain in or upon any public
way as defined in SJ -A M.R.S.A. g 505, within the
City of Bangor between the hours of 6:00 A.M. and
12:00 midnight, Eastern Standard Time or Eastern
Daylight Time as may then be in effect, except as
Is permitted by the following;
Parking will only be permitted on the odd -
numbered side of each public way on the odd -
numbered days of the month; and parking will be
permitted only on the even -numbered side of each
public way on the even -numbered days of the
month.
(a) Exceptions. The alternate side parking
restrictions in Subsection
6.1.2 above shall not apply to:
(1) Metered streets and ways; or
(2) On portions of public ways where
parking is otherwise prohibited.

6.1.3 Snow Removal. Motwithstanding the provisions of
Subsections 6.1.1 and 6.1.2 above,
no person shall stop, stand or park, or allow to
remain, a vehicle in or upon any public way as
defined in 17-A M.R.S.A. S 505, Public square,
or on -street or off-street public parking area
within the City of Bangor during any hour of the
day so as to interfere with or hinder the removal
of snow by the City from such way, square or
parking area. Any vehicle found to be parked in
violation of this Subsection may be removed and
placed in a suitable parking place in accordance
with the procedures described in 29 M.R.S.A.
g 1111.
6.2 Parking Meters - Schedule XII. The City Manager is
hereby authorized and
directed to cause parking meters to be placed, installed
or ¢moved at on -street and off-street public parking
locations owned, leased or operated by the City of
Bangor, or leased by the City to private parking lot
operators, said locations and conditions for parking at
them being established under Schedule XII.
6.2.1 Meter violations. It shall be unlawful and a
violation of this Article
for any person to:
(a) Park, or permit to remain parked, a
vehicle in a metered parking apace
when the time signal on the parking
meter for such space indicates that
the permissible parking time has
expired.
(b) Park a vehicle in a metered parking
zone for a period of time exceeding
the maximum time established for
parking in said sone.
(c) Deface, injure, tamper with, open or
wilfully break, destroy or impair the
usefulness of any Parking meter installed
under the provisions of this Article.
(d) Deposit or cause to be deposited in any
parking meter, any device, slug or metallic
substance or any substitution for currency
of the United States.

6.2.2 Prima Facie evidence. In accordance with 30-A
N.R.S.A. S 3009 the fact
that a vehicle Is in a metered parking apace when
the time signal on the parking meter for such
space indicates no parking permitted without the
deposit of a coin Or coins shall be prima facie
evidence that said vehicle has been parked in
said parking space longer than the lawfully
permitted period. In addition, the fact that a
vehicle is unlawfully parked shall be prima
facie evidence of the unlawful parking of such
vehicle by the person In whose name such vehicle
�) is .registered.
Closure of Parking Lots and Areas. It shall be unlawful
cL6 and a violation of
this Article for any person to stop, stand or park a
vehicle, or to enter or remain in any City parking lot
or area after said parking lot or parking area has been
blocked off or closed tgublic use by the directive of
the Chief of Police>or1&11 designees Such directive
(
IV w°r'f may be issued upon a determination that the persons
using said parking lot or area are participating in
acts of vandalism, disorderly conduct or otherwise
conducting themselves in violation of the law. The
Chief or his designee shall cause signs and/or
barricades sufficient to notify the public of such
directive to be located at the entrance to such lots
or areas.
6.4 Continuous Parking Prohibited. Notwithstanding the
provisions of Sec. 6.1,
it shall be unlawful to park a vehicle on any public
way, public parking area or public land for a continuous
period exceeding 24 hours.
6.5 Removal of Unauthorised Vehicles. Any vehicle found in
violation of say

a -d G•O Qgfy e2t in accordance with the procedures established under
Chapter III, Article 6, Section B. Subsections 8.3 NOO F,/
thssugh 8.5 of this Ordinance.

Sec. 7 Waiving Court Hearing for Violation. Any person accused of
a violation of any
portion of this Article may voluntarily waive his or her
right to appear and defend before any Court the charge made
against him or her for such illegal parking by paying to the
municipality the sum shown in Sections 7.1 through 7.5 of
this Article within thirty (30) days following the date such
to
alleged offense was cos tted. If the waiver fee is not
Paid within said thirty (30) days and a hearing has not
been scheduled before a court, the waiver fee will
automatically double.
7.1 The waiver fee for any person accused
used of a violation
relating to illegal occupancy of two parking spaces,
parking in an off-street area without a valid permit or
violation of ODD/EVEN parking shall be Ten Dollars
($10.00) if paid within thirty (30) days of the alleged
offense, and Twenty Dollars ($20.00) thereafter.
7.2 The waiver fee for any person accused of a violation
relating to loading zones, blocking driveways, Parking
in areas marked "No Parking", night parking, double
Parking, blocking snow removal, Parking with left wheel
to curb or ANY OTHER VIOLATION NOT MENTIONED IN SECTIONS
7.1 through 7.5 shall be Twenty Dollars ($20.00) if paid
within thirty (30) days of the alleged offense, and
Forty Dollars ($40.00) thereafter.
7.3 The waiver fee for any person accused of a violation
relating to tow away zones, fire lanes, fire hydrants,
crosswalks, sidewalks or esplanades shall be Twenty-
five Dollars ($25.00) if paid within thirty (30) days
of the alleged offense, and Fifty Dollars ($50.00)
thereafter.
7.4 The waiver fee for any person accused of a violation
relating to handicapped Parking shall be Fifty Dollars
($50.00) if paid within thirty (30) days of the alleged
offense, and One Hundred Dollars ($100.00) thereafter.
7.5 The waiver fee for any person accused of a violation
relating to overtime parking, parking at expired meter,
and overtime parking at expired meter, shall be Seven
Dollars and Fifty Cents ($7.50) if paid within thirty
(30) days of the alleged offense, and Fifteen Dollars
($15.00) thereafter.
Sec. 8 Impoundment of Motor Vehicles for Failure to Pay Parking
Tickets.
8.1 Intense. This ordinance is enacted as an enforcement
procedure for promotion and protection of the
public peace, safety and welfare, and the safeguarding
of property, and shall be used generally for the
prevention and rain val of traffic hazards, prevention
and abatement of public nuisances arising from traffic
infractions, and for the protection of the public
rights in the use of city streets, thoroughfares,
parking areas, parking lots, and public ways.

8.1.1 Notice. written notice shall be mailed to the
owner of any vehicle which has
accumulated three (3) or more outstanding
notices of violation of any parking ordinance
or regulation therein prior to immobilization
or Impoundment of such vehicle as provided in.
Subsection 8.2. The notice shall inform said
owner of the nature and number of outstanding
violations, that such vehicle may be immobilized
In place or impounded, and that said owner will
be provided an opportunity to contest the
validity of the proposed Immobilization or
impoundment upon written request to the Chief
of Police within tan (10) days of receipt of the
notice described in this Subsection. -
8.1.2 Hearing. Any owner who requests an opportunity
to contest the validity of proposed
immobilization or impoundment of his vehicle
shall be provided an administrative hearing upon
written request to the Chief of Police. Such
hearing shall be scheduled as soon as practicable
before a hearing officer, who shall be solely
responsible for hearing and deciding all contests
provided herein. Enforcement of the provisions
of Subsection 8.2 shall be stayed pending the
decision of the hearing officer. The purpose of
this Subsection is to provide an opportunity to
contest the validity of a proposed immobilization
or impoundment, and not to contest the merits of
parking violations.
8.1.3 Nearing Officer. The Chief of Police shall
designate a hearing officer
from time to time as may be needed. No City
employee may serve as a hearing officer for the
purposes of this Article.
8.2 Avolicabilfty. My vehicle, which has accumulated three
(3) or more notices of violation of any
parking ordinance or regulation therein of the ordi-
ounces of the City of Bangor for which there has been
either payment of waiver fees nor issuance of court
process and which is then parked upon the public way or
in a public parking lot at any time, may, at the option
of any City of Bangor Police Officer or other City
employee authorized to enforce said parking ordinance
or regulation be Immobilized in place or may be removed
and stored until all waiver fees established pursuant
to Chapter III, Article 6, Ordinances of the City of
Bangor, for all of such outstanding notices of

violations and also the impoundment, storage and other
chargee authorized under this ordinance have been paid.
If impoundment by immobilization is utilized, a charge
for such impoundment of 525.00 shall be charged and paid
prior to such release.
8.3 PYOCedvre. As soon
as a vehicle has been removed and
stored or immobilized in place under this
ordinance, the Police Officer or other municipal
employee taking such action shall so notify the Police
Department dispatcher. Such information shall be
corded by the dispatcher for the use of the Chief of
Police, the Finance Director, or his authorized
representatives. In addition, the Chief of Police shall
notify by registered mail the registered owner of such
vehicle within five (5) business days of the impoundment
or immobilization thereof. Said notice shall state the
location of such vehicle and therequirements for
release as set forth in this ordinance.
8.4 Release of vehicles. Any person having custody of a
motor vehicle impounded pursuant
to this ordinance or of the means to release such
immobilized vehicle, shall not release it until the
individual requesting its release presents satisfactory
evidence of his or her right to possession and signs a
receipt therefor. In addition, said vehicle shall not
be released until the Finance Director, the Chief of
Police, or their duly authorized representatives,
certify that all waiver fees and all other charges
provided for in this ordinance have been paid, including
all costs of impoundment, towing, notices and storage
or until the Finance Director, or his duly authorized
representatives, shall have certified the posting of a
bond equal to the total outstanding waiver fees which
should have been remitted for said -overdue notices of
violation and other charges as set forth in this
Subsection.
8.5 Bond. Whenever any person requests the right to post
bond pursuant to this ordinance, such bond shall
be given in cash and receipt given therefor. Such bond
money shall be refunded in the amount of the waiver fee
for each alleged violation of this ordinance upon
acceptance by such person of service of process
initiating a court proceeding to determine his or her
liability for the described penalty or such alleged
violation. Any bond shall be forfeited unless the
Person posting it requests and accepts service of such
process from the Chief of Police or his or her desig-
nated representative within thirty (30) days of posting
unless prevented from doing so by actions or inactions
of the City of Bangor.

8.6 Violations. it shall be a violation of this ordinance
for any person to tamper with or attempt
to remove any immobilising device attached to a vehicle
or to extract or attempt to prevent the removal of any
vehicle as provided herein. The penalty for any such
violation shall be not less than $50.00 nor more than
$10000.00.

at all locations not designated as a -1/2 hour, 1 hour, 2

3.2 Parking Limited to One Hour - Schedule VII. To stop,
stand or
Park a vehicle for more than one (1) hour between the
hours of 8x00 A.M. and 500 P.M., except on Saturdays,
Sundays and Holidays when such parking may be permitted,
on those streets or portions of Streets duly marked o
posted and which are described or specified in Schedule
VII.
3.3 Parking Limited to Two Hours - Schedule VIII. To stop,
stand or
park a vehicle for more than two (2) hours between the
hours of 8:00 A.M. and 5:00 P.M., except on Saturdays,
Sendays and Holidays when such parking .may be permitted,
on those streets or portions of streetsduly marked or
posted and which are described or specified in Schedule,
VIII.
Sec. 4 On -Street Parking - Parking Prohibited Except for Uesianted
Uses. It shall be unlawful and in violation at this Article
for any person:
4.1 Parkin Prohibited Except Loading and Unloading for
Commercial Uses and Taxicabs. To atop, stand or park
a vehicle for any purpose
r length of time, other than for the expeditious
unloading and delivery or pick-up and loading of
Passengers or freight for a taxicab or commercial
vehicle, within any of the spaces duly marked or posted
and described or specified in Schedule IX. The rights
granted hereunder shall be limited to one continuous
Period of 15 minutes per day for each vehicle.
4.2 Parkins for Handicapped - Schedule X. To atop, stand
or park any
vehicle not displaying a valid handicapped license plate
or placard issued under 29 M.R.S.A. 5 252, or a similar
plate issued by another State on those streets or
Portions of parking areas duly posted and which are
described or specified in Schedule X.
Parking areas designated under Schedule X shall also
be subject to the time and manner of parking and fees
as may be established under this ordinance from time to
time.
4.3 Parking for Police Vehicles Only Schedule Xi. To
stop,
stand or park any vehicle, other than a municipally -

4.4 Parking for Busses Only- Schedule XII. To stop,
stand or
park any vehicle other than a bus, on those streets
or portions of streets or in those portions of
parking areae duly pasted and which are describedor
specified in Schedule XII.
4.5 Parking for Rental Vehicles - Schedule XIII. aro atop,
stand or.
park any vehicle, other than a vehicle belonging to a
rental car agency having a place of business at Bangor
International Airport on those streets or portions of
streets or in those portions of parking areas located at
said Airport duly posted and which are described or
specified. in Schedule %XII. - -
Sec. 5 Off -Street Permit Parking. It is hereby declared to be a
policy of the City of Bangor to
provide for off-street permit parking. From time to time the
City Manager may take all necessary action to provide for
off-street areas for parking by permit only at such locations
and upon such terms and conditions as may be approved by the
City Council.
5.1 Off -Street Permit Parking Lots Established. 0£f -street
permit
parking lots and the terms and conditions orderwhich
they shall be operated are hereby established at those.
locations described in Schedule XIV.
5.2 Violations. It shall be unlawful and in violation of
this Section for any person to:
5.2.1 Cause, allow, permit or suffer any vehicle
registered in the name of, or operated by
such person, to be parked within any
established off-street permit parking area
within the City unless a. permit for such
purposes has been issued. tosuch person as
provided herein.
5.2.2 Cause, allow, permit or suffer any vehicle
registered in the name of, or operated by
such person, to be parked within any
established off-street permit parking area
within the City in violation of the terms
antl conditions ofanypermit issued as
provided herein. -

5.3 Removal of Unauthorized vehicles. No motor vehicle
Shall be permitted
within any off-street parking lot established pursuant
to the provisions of this Section unless a permit for
such purposes has been issued as provided herein. Any
vehicle found in violation of this Section 5 may be
removed and impounded in accordance with the
procedures established under Chapter III, Article 6,
Section 8, Subsections 8.3 through 8.5 of this
ordinance.
Sec. 6 Miscellaneous Provisions - On -street and Off -Street
Parkin Areas.
6.1 Wintertime Parkins. It shall be unlawful and in
violation of this Article between
November 1 and March 31 of each calendar year, for any
person:
6.1.1 Night-time Parking Prohibited. To stop, stand or
park or allow to
remain, a vehicle in or upon any public way a
defined in It -A M.R.S.A. 5 505, public square, or
-street or off-street public parking area with-
in the City of Bangor between the hours of 12:00
midnight and 6:00 A.M., Eastern Standard Time or
Eastern Daylight Time, as may then be in effect.
(a) Exceptions. Notwithstanding the provisions
of Subsection 6.1 above,
parking will be permitted beyond the hours
of 12:00 midnight, Eastern Standard Time or
Eastern Daylight Time, as may then be in.
effect as follows:
(1) On a regular basis at such times, days
of the weeks, special teras and conditions,
and locations as maybe established in
Schedule W.
(2) On a temporary basis for special events,
meetings or functions at such times, dates,
special terms and conditions, and locations
as may be authorized by special permit issued
by the Chief of Police.
6.1.2 Alternate -Side Parking in Daytime. To stop,
stand o
Park, or allow to reamin
upon any public
way as defined in 1]-AM.R.S.A. S 505, within the
City of Bangor between the hours of 6:00 A.M. and.
12:00 midnight,Eastern Standard Time or Eastern
Daylight Time as may then he in effect, except as
is permitted by the following:
Parking will only be permitted on the odd -
numbered side of each public way on the odd -
numbered days of the month; and parking will be
permitted only on the even -numbered side of each
public way on the even -numbered days of the
month.
(a) Exceptions. The alternate aide parking
restrictions in Subsection
6.2 above shall not apply to;
(1) Metered streets and ways; or
(2) On portions of public ways where
Parking is otherwise prohibited.
6.1.3
Snow Removal. Notwithstandingtheprovisions of
Subsections 6.1.1 and 6.1.2 above,
no person shall stop, stand or park, or allow. to
remain, a vehicle in or upon any public way as
defined in 17-A M.R.S.A. S 505, public square,
or on -street or off-street public parking area
within the City of Bangor during any hour of the
day so as to interfere with or hinder the removal
of snow by the City from such way, square o
parking area. Any vehicle found to be parked in
violation of this Subsection may he removed and.
placed in a suitable parking place in accordance
with the procedures described in 29 M.RS.A.
5 1111.
6.2 Parking
Meters. The City Manager is hereby authorized
and directed to place, install and
remove
parking meters upon the curb aide of on -street
individual parking places as designed, designated and
marked
off under the provisions of this Article and to
place,
install and remove parking meters in individual
parking places designated and marked off in off-street
public
parking areas owned, leased or operated by the
.City of Bangor.
6.2.1
Establishment of Parking Meter Zones. On -street
and off-
street parking meter zonese hereby established
as designated on Schedule "I.
6.2.2
Meter violations. It shall be unlawful and a
violation of this Article for
any person to,

(a) Park, or permit to remain parked, a vehicle
in a metered parkingspacewhen the time
signal on the parking meter for such apace
indicates that the permissible parking time
has expired.
(b) nark a vehicle in a metered parking zone
for a period of time exceeding the maximum
time established for parking In said zone.
(c) Deface, injure, tamper with, open or
wilfully break, destroy or impair the
usefulness of any parking meter installed
under the provisions of this Article.
(d) Deposit or cause to be deposited in any,
parking meter, any device, slug or metallic
substance or any substitution for currency -
of the United States.
6.3 Closure of Parking Lots and Areas. it shall be unlawful
and a violation of
this Article for any person to stopk, stand or park a
vehicle, or to enter or remain in any City parking lot
or area after said Parking lot or parking aa has been
blocked off c closed to public use by the directive of
the Chief of Police or his designee. Such directive
may be issued upon a determination that the persons
using said parking lot or area are participating in
acts of vandalism,. disorderly conduct or otherwise
conducting themselves in violation of the law. The
Chief or his designee shall cause signs and/or
barricades sufficient to notify public of such
directive to be located at the entrance to such lots -
or areas.
6.4 continuous Parking Prohibited. Notwithstanding the
provisions of Sec. 6.1,
it shall be unlawful to park a vehicle on any public
way, public parking area or public land for a continuous
period exceeding 24 hours.
Sec. 9 waiving Court Nearing for Violation. Any person accused of a
violation of any
portion of this Article may voluntarily waive his or her
right to appear and defend before any Court or judicial
tribunal the charge made against him or her for such illegal
parking by paying to the municipality, within thirty (30)
days of the date such alleged offense was commented, the sum
designated for such violation as shown on Schedule xvii.

Sec. 8 Impoundment of Motor Vehicles for. Failure to -Ray -Parkin
Ea&k€2.
8.1 Pur ase. This ordinance is enacted as an en£orCement
procedure for promotion and protection of the
public peace, safety and welfare, and the safeguarding
of property, and shall be used generally for the
prevention and removal of traffic hazards, prevention
and abatement of public nuisances arising from traffic
infractions, and for the protection of the public
rights in the use of city streets, thoroughfares,
parking areas, parking lots, and public ways.
8.1.1 Notice. Written notice shall be mailed to the
owner of any vehicle which has
accumulated three (3) or more outstanding
notices of violation of any parking ordinance
or regulation therein prior to imsobilization
or impoundment of such vehicle as provided i
Subsection 8.2. The notice shall inform said
owner of the nature and number of outstanding
violations, that such vehicle may be immobilized
in place or impounded, and that said owner will
be provided an opportunity to contest the
validity of the proposed immobilization or
impoundment upon written request to the Chief
of Police within ten (10) days of receipt of the
notice described in this Subsections
8.1.2 Hearing. Any owner. who requests an opportunity
to contest the validity of proposed
immobilization or impoundment of his vehicle
shall be provided an administrative hearing, upon
written request to the Chief of Police. Such
hearing shall be scheduled as soon
as practicable
before a hearing officer, who shall be, solely
responsible for hearing and deciding all contests.

of Suheectfon 8.2 shall be stayed pending the
decision of the hearing officer. The purpose of
this Subsection is to provide an opportunity to
contest the validity of a proposed immobilization
or impoundment, and not to contest the merits of
parking violations.
8.1.3 Hearin officer. The Chief of Police shall
designate a hearing officer
from time to time as may be needed. No City
employee may serve as a hearing officer for the
purposes of this Article.

0.2 Aoolfcability. My vehicle, which has accumulated three
(3) or more notices of violation of any
parking ordinance or regulation therein of the ordi-
ounces the City of Bangor for which there has been
neither payment of waiver fees nor issuance of court
process and which is then parked upon the public way or
in a public parking lot at any time, may, at the option
of any City of Bangor Police Officer or other City
employee authorised to enforce said parking ordinance
or regulation be immobilized in place or may be removed
and stored until all waiver fees established pursuant
to Chapter III, Article 6, Ordinances of the City of
Bangor, for all of such outstanding notices of
violations and also the impoundment, storage and other
charges authorized under this ordinance have been paid.
If impoundment by immobilisation is utilised, a. charge
for such impoundment of $25.00 shall be charged and paid
prior to such release.
8.3 Procedure. As soon as a vehicle has been removed and
stored or immobilized in place under this
ordinance, the Police Officer or other municipal
employee taking such action shall so notify the Police
Department dispatcher. Such information shall be
recorded by the dispatcher for the use of the Chief of
Police, the Finance Director, or his authorised
representatives. In addition, the Chief of Police shall
notify by registered mail the registered owner of such
vehicle within five (5) business days of the impoundment
orimmobilisation thereof. Said notice shall state the
location of such vehicle and the requirements for
release as set forth in this ordinance.
8.4 Release of Vehicles. My person having custody of a
motor vehicle impounded pursuant
to this ordinance or of the means to release such
immobilized vehicle, shall not release it until the
individual requesting its release presents satisfactory
evidence of his or her right to possession and signs a
receipt therefor. In addition, said vehicle shall not
be released until the Finance Director, the Chief of
Police, or their duly authorized representatives,
certify that all waiver fees and all other charges
provided for in this ordinancehave been paid, including
all costs of impoundment, towing, notices and storage
or until the Finance Director, or his duly authorized
representatives, shall have certified the posting of a
bond equal to the total outstanding waiver fees which
should have been remitted for said overdue notices of
violation and other charges as set forth in this
Subsection.

8.5 rand. Whenever any person requests the right to post
bond pursuant to this ordinance, such bond shall
be given in cash and receipt given therefor. Such bond
money shall be refunded in the amount of the waiver fee
for each alleged violation of thisordinanceupon
acceptance by such person of service of process
initiating a court proceeding to determine his or her
liability for the described penalty or such alleged
violation. Any bond shall be forfeited unless the
Person posting it requests and accepts service ofsuch
process from the Chief of Police or his or her desig-
nated representative within thirty (30) days of posting.

8.6 violations. It shall be a violation of this ordinance
for any person to tamper with or attempt
to remove any immobilizing device attached to a vehicle
or to extract or attempt to prevent the removal of any
vehicle as provided herein. mhe penalty for any such
violation shall be not less than $50.00 nor more than
$1,000.00.
