ORDERED,
THAT
WHEREAS, certain properties designated as Lots Noe. 8-E, 9, 9-A,
9-B on Assessor's Map No. R-18, and Lot No. 8, Assessor's Nap No.
R-17 are presently burdened by security easements relating to the
Operations of the former Dow Air Force Mae, which ars unnecessary
to the present operation of Bangor International Airport; and
WHEREAS, the owners of these properties have proposed to exchange
an easement securing airspace rights to the City, but removing
other burdens on their properties in return for the City's release
of the security easements; and
WHEREAS, the Federal Aviation Administration hoe approved such an
exchange,
NOW, THEREFORE, by the City Council of the City of Bangor, be it
ORDERED,
THAT the City Manager is authorized to execute releases of the
security zone easements affecting properties designated as Lots
Nos. 8-E, 9, 9 -A,9 -B on Assessor's Map No. R-18, and Lot No. 8,
Assessor's Nap No. R-17, said releasee to be delivered upon receipt
of avigation easements in a form approved by the City Solicitor.

MEMORANDUM
December 10, 1990
TO: Bangor City Council

RE: Nuclear Easements
In the area of the Odlin Road and the Hammond Street bulge,
there are
several privately -owned properties which are.encumtiered
by nucleareasements previously obtained by the Federal Government.
When Dow Air Force Base was
operated as a military base. Those
easements were transferredto the City as a part of the acquisition
of the airfield from the Federal Government in the late 1960'x.
A few years ago owners of the property contacted the City
for purposes of seeking release of the easements. At that time a
decision was made not to grant their requests. Later discussions
resulted in a general agreement that the easements could be
released if the owners would grant to us avigation easements in
return. The Council was advised of the transactions, and formal
action was taken to petition the FAA for approval. Since that time
the FAA has given us notice that they have no objection to the
proposed swap of easements.
in the past the Air National Guard has also asked us to not
release easements because of concerns and potential needs on their
part for the Ready Alert Area. Most recently the Air Guard has
also indicated no objection to the proposed transfer.
At the next Municipal Operations Committee I will review
the entire transaction, showing specifically what properties are
affected and providing copies of the proposed documents for the
Committee's review. Hopefully at the next Council Meeting the
matter will be in order for formal approval by the Council. A copy
of an Order which has been drafted for such purposes is enclosed
for your consideration.
No formal action is needed at tonight's meeting. However,
in the meantime if any member of the Council has any questions
regarding the matter, please contact me.
