Earlier this year, Albert N. Peterson, a long-time resident of
Bangor, age 94, died, leaving a residence at 546 Broadway as the
primary asset of his estate. Prior to his death, Hr. Peterson had
listed the residence for sale, but had been unsuccessful in
attracting a buyer due to the residence's location immediately
adjacent to Interstate 95. A zone change request was previously
defeated by the Council, on recommendation by the City Planning
Board, due to concerns about additional traffic and the possible
adverse impact on the neighboring residential lots in the Falvey
Street area. An attempt to obtain a variance so as to allow a
commercial use of the property also failed, with the variance
request denied by the City's Zoning Board of Appeals.

Since Mr. Peterson's death, two beneficiaries of his estate have
approached the City with a request to purchase 37' x 200' strip .
of the City's property abutting 546 Broadway. The purchase i
necessary to allow for creation of additional frontage, off-street
parking and buffer yards, in support of a contemplated contract
zone change request that will more properly address the City's
traffic and neighborhood concerns.
In return for the conveyance by
the City, the City would receive an easement to maintain, etc., an
existing City semer line across the Peterson property, for which we
have no recorded easements The City would also receive an easement
extending 5 feet in depth along the property's Broadway frontage,
for highway purposes, to accommodate any future widening of
Broadway in the I-95 interchange area.
City staff have reviewed the request by the Peterson heirs, and
concur that it represents a fair exchange of value, as well as a
reasonable approach to permit future use of this rather isolated
residential lot.

ORDERED,
THAT the City Manager is hereby authorised to convey to
Ruby B. Faulkner and Frank D. Faulkner, beneficiaries under the Will
of Albert N. Peterson, or their designees, certain City -owned
property, adjacent to 546 Broadway, consisting of a strip of land 37'
x 200' Q depicted in the attached sketch. Said conveyance shall be
in a foil acceptable to the City Solicitor. The City Manager shall
deliver She deed to the property concerned upon tender of the
following `to the City:
41) A sewer easement deed conveying a 20' easement
to the City of Bangor for purposes of replacing,
maintaining, etc. an existing sewer line across
the Albert N. Peterson property as shown i
Sewer Book 4, Page 57, in the City Engineer's
Office; and
�$) An easement deed conveying to the City of Bangor
a an easement for highway purposes along the
existing frontage of the Albert N. Peterson
property, extending five feet (51) back from the
westerly line of Broadway.
