The City of Bangor holds a number of matured and non -matured tax
against a -residential property at 148 Garland Street formerly owned
by Carl P. Broad. Our tax liens date from 1986 to 1992. No taxes
have been paid on the property by Mr. Broad since 1986. In
addition to the City's tax liens, there are outstanding sewer
charges dating from 1988. Aside from the City's tax and sewer
liens, there are no mortgage holders or other recorded encumbrances
on the property.
The City has properly foreclosed its matured tax liana and now
holds title to 148 Garland Street. However, Carl Broad remains in
possession of the property, and the City has as yet taken no steps
to evict him.

Recently, as a result of discussions with the City's Assessing
and Legal Departments, Mrs. Elvin F. Savoy, Carl Broad's mother,
has tendered a check to the City of Bangor in the amount of
$11,468.78 in full payment of all taxes and back s charges owed
by Mr. Broad, including interest, lien charges and e�current year [FY
1993] real estate taxes. In return, Mrs. Savoy has asked that
title to the property be released by the City back to Mr. Broad.
The attached Council Order would authorize a release of the
property.
This item has been place on the Council's regular agenda
because unlike many of our tared tax lien situations, the City
has properly foreclosed all Mr. Broad's redemption rights under 36
MRSA ££ 942-944. The City is free to decline Mrs. Savoy's offer
and to sell the property at public auction or otherwise for full
market value. The City's peat practice, however, generally has
been to use the tax lien process as a means of collecting its taxes
rather than as a means of acquiring title, especially where an
occupied residential property is involved. The City, in past
years, has allowed a number of redemptions beyond the tax
foreclosure date. Recently, for example, the City agreed to allow
a redemption of the Central Building in downtown Bangor for some
$84,000+ in taxes owed, notwithstanding that the City had properly.
foreclosed its matured tax liens. where the City has retained
title to tax -acquired property, the properties concerned most often
have been vacant land, land or buildings otherwise scheduled for
acquisition under the Community Development or Urban Renewal
programs, or for park or other City purpoeea, Or property to which
the City has held tax title for an extended number of years.
Because this item involves an occupied residence and is not
otherwise scheduled for City acquisition, the staff and Committee
recommendations are for approval of the item, consistent with the
City's past tax collections practice.

execute a Municipal Quitclaim Deed, a copy of said Deed on file
in the office of the City Clerk, releasing any interest the City

may have in the real estate located at 148 Garland Street by
'virtue 0$ nndischanged tax liens recorded against said property
in the Penobscot Registry of Deeds for the tax years 1986-1991.
Said Deed shall be directed to Carl F. Broad.

MUNICIPAL QUITCLAIM DEED
The CITY OF BANGOR, abody corporate, located at Bangor, County of
Penobscot, State of Maine, for consideration paid, releases to CARL F.
BROAD, of Bangor, County of Penobscot and State of Maine, all its right,
title and interest in certain property more particularly described as.
follows:
Real estate located at 148 Garland Street in said
Bangor, and further described in a dead recorded
In volume 3167, Page 101, Penobscot Registry of
Deeds.
Being the same premises acquired by said City of Bangor
(by John G. Field, Deputy Finance Director) for unpaid
taxes assessed for the years 1986 through 1991 by virtue
of undischarged tax liens recorded in the Penobscot
Registry of Deeds in volume 3822, Page 206; volume
4024, Page 44; volume 4230, Page 226; Volume 4442, Page
228; Volume 4037, Page 334; and Volume 4647, Page 306
respectively.
The purpose of this deed is to release to said Carl F. Broad any
Interest the City may have in the above-described property by virtue of
unpaid taxes assessed for the tax years 1986-1991, together with any sewer
liens recorded for the period 1986-1992.
The said CITY OF BANGOR has cused this instrument to be sealed
with its corporate seal, and signed in its corporate name by JOBN
QUARTARARO, Finance Director, thereunto duly authorized, this _ day
of September, 1992.
