Applications for zoning amendment must be filed in the Planning Division Office at City Ball (with necessary advertising and processing fees). 2:' A council Order containing the proposed zoning amendment must be drawn up by the Planning Office and placed on the Council Agenda 3. A public hearing must be scheduled to be held by the Planning Board on the proposed amendment (the City Council can take no action until afterthePlanning Board hearing and report). 4. A notice of the public hearing most be placed in a newspaper at least 10 days prior to the hearing and a notice must be mailed t owners of abetting property within 100 feet of the property subject to, rezoning action. 5. The Planning Board meets twice:a month on the first and third Tuesdays at ],30 p.m. and the City Council meets twice a month on the second and fourth Monday's at 7z30 p.m. (Except on holidays). C. Notification You will receive notice of the public hearing held by the Planning Board. After the Planning Board has voted on its recommendation to the City Council concerning your application, the City Council will consider your application at the next regular meeting. You will not receive formal notice of the City Council meeting. General Description., Applicant requests a anchange from a Rural Residential and Agricultural District (RR A A) to a General Commercial and Service District (GC 6 S) for a 19.5 acre parcel located at 1120 Stillwater Avenue. b. Land use and Zoning F,nliCy_.. The proposed zone change i consistent with both the Land Use Concept Map and Zoning Policy Map which reserves this area for commercial uses. e. Existing. Conditions. The current use of the land is vacant agricultural land. All of the property on the north side of Stillwater Avenue which abuts this parcel iszoned Rural Residential and Agricultural. However, the property direct- ly across the street (Bangor Mall Business Park) is zoned Shopping and Personal Service and General Commercial and Service Districts. d. Hrhan,Services. with the approval of H.Q. and the Bangor Mall Business Park public water and service is being extend- ed to within 150 feet of this property. Because this area is within a two mile distance of a fire station and within one mile of City transit service, the Primary Service Area has been extended to include this area. a. Decision Criteria., The proposed zone change request is consistent with Comprehensive Plan's Land Use Policy and Land Use Concept Maps. In addition, the proposed commercial zoning is consistent with the zoning directly across the street. f. Recommendation Because the proposed zone change is consis- tent with the City's Comprehensive Plan, consistent with existing zoning across the street and is located within the Primary Service Area, Staff would recommend that the Plan- ing Beard recommend the proposed zonechange to the City Council.
