ORDEMD,
THAT pursuant to Chapter I, Article 6, Section 4.6, Bangor
City Ordinances, the following questions are hereby referred to the
City of Bangor Board of Ethics for the rendering of an advisory
opinion in accordance with Section 4.5:
Question 1: Does City Councilor Richard Stone have a past or
present business relationship with Richard Ade, partner in the
counting firm of Lager, Ade and Associates?
Question 2: It so, does the relationship amount to a special
interest" under Section 2.6 of the City's Code of Ethics?
Question 3: If the answer to Question (2) is yes, does the
special interest prohibit Councilor Stone from participating in the
approval or recommendation of a contract for City of Bangor
auditing services, where the Lager, Ade accounting firm has
submitted a proposal to provide such services in response to the
City of Bangor's published request for proposals?
The foregoing questions are based on the following statement
On August 10, 1992 Councilor Stone participated in discussion -
-" —'-"- -Ofi Bad voted'Oni Council Order 42 -384, -which awarded.a
contract for City Audit Services for EY 1992 to the accounting
firm Brantner, Thibodeau and Associates. Among the firms
submitting proposals to provide such services to the City of
Bangor was the Bangor accounting firm Lager, Ade and
Associates. Council Order 92-384 also awarded a contract for
preparation of an "Indirect Cost Allocation Plan^ to the
Lager, Ade firm. This award was made upon amendment of
Council Order 92-384 following passage of a motion to divide
the question, proposed by Councilor Stone.
and be it further,
ORDERED, THAT the Board of Ethics is directed to investigate
the following factual questions, and for that purpose to receive
voluntary statements and to review public records as necessary to
develop its factual findings.
Factual questions:
(1) Whether Councilor Stone and Mr. Ade are currently
r have in the past been partners in the "Essex
Green^ mobile home park project on Essex Street?
(2) Whether Councilor Stone and Mr. Ade are currently
r have in the past been partners in ownership
of the United Bank building on. Hammond Street?
(3) Whether Councilor Stone and Mr. Ade are currently
r have in the past been partners in the
redevelopment of the former Phenix Inn (now
Quality Inn)?
(4) whether the Lager, Ade accounting Eire is
currently employed by Mr. Stone or his business,
Standard Electric Company?
