Amending Agreement Between the City of Bangor and Grant's Dairy,

Commentary:
A minor amendment to the existing agreement between the City of Bangor and
Grant's Dairy is proposed. The change represents the installation of a
6" private spearlinerather than. the 8" originally called for in the
agreement. The attached memorandum will describe the change in more detail.

TBAT the agreement between and among the City of Bangor and Grant's
Dairy Inc., Benjamin E. Grant and Ellen Grant Young be amended as follows:
4. Concurrent with the construction of Phase I Grant shall construct an
eight-4nch—f8ui's nch (6") private sewer line from Hlldreth
Street to the building being constructed on the Hlldreth Street site
in accordance with depiction on Schedule A. The City will reimburse
Grant for the costs of construction of this sewer line.

RE: Grant'a Daisy Agreement Amendment
The City of Bangor and Grant's Dairy approved an Agreement in
October 1990 which facilitated the development of a major project at
site located east of North Rildreth Street. As part of this
Agreement, Grant's agreed to construct a multimillion dollar dairy
facility and the City extended road water and other services to the
project site.
Part of the Agreement called for the construction of an 8 inch
private sewer line to the project site by Grant's Dairy and City
reimbursement for such coat from the project development fund.
Grant's has recently submitted a request for reimbursement for
sewer line construction in the amount of $9,661. However, the sizing
of the sewer line was changed from an 8 inch to a 6 inch line.
According to the contractor, this reduction was done after
consultation with the City Sewer Department Staff. City Engineering
Staff has indicated that they have no technicalconcerns over the
reduction in size and that the construction coat for the sewer line
is reasonable.
Since the sewer line size designated in the Agreement has been
changed, it is necessary to amend the Agreement prior to reimbursing
Grant's Dairy. Staff believes that such an amendment is appropriate
and therefore recommends approval.
