Commentary:
Christopher Hutchins, as Trustee of Burgundy Realty Trust,
which has recently completed rehabilitation of the waterfront
building located at 20 South Street, has offered to demolish and
clear the former MCRA switching tower, located adjacent to the
Burgundy Realty Trust property and new owned by the City of
Banger. Burgundy Realty Trust has also requested permission to
grade, landscape and maintain this property which will save the
City the cost of demolition, clearance, grading, landscaping,
and maintaining this property.

ORDERED,
THAT WHEREAS, the City Council of the City of Bangor
approved and adopted the Penobscot River Waterfront Plan by
passage of Council Order 90-35 on January e, 1990; and
wHRREAS, said plan provides for the acquisition
and clearance of properties in the project area which do not
meet minimum code standards and which rehabilitation is not
appropriate; and
WHEREAS, a goal of said Plan is to remove blighted
and slum properties and properties having a blighting influence
on other properties in the Project, to provide land necessary
for needed public improvements and open space, and to remove
uses incompatible with the Project's Land Use Plan; and
WHEREAS, the building and property designated as
Parcel 32 on Assessor's Map 93 was acquired by the City of
Bangor to achieve the above goal;
NOW THEREFORE, BY THE CITY COUNCIL OF THE CITY OF
RAWGOR, BE IT ORDERED TRAP, the City Manager is hereby
authorized, in a from acceptable to the City Solicstor, to grant
Burgundy Realty Trust permission to demolish and remove a two
story building owned by the City of Bangor located at the
intersection of Front Street and Railroad Street in the City of
Bangor, and to grant Burgundy Realty Trust permission to grade,
landscape and maintain property owned by the City of Bangor
between Railroad Street, Front Street, the railroad easement and
Property presently owned by Burgundy Realty Trust.
