Responsible Department: Community and Economic Development Commentary: This easement executes a portion of the previously approved agreement between the City and Burgundy Realty Trust. It permits placement of a sign and gas tanks within the sight -of -way located at Pleasant and South Streets. The Community and Economic Development Department has reviewed this item and has recommended approval. By the City Caused of Ste My of Bm -' ORDERED, THAT the City Manager is hereby authorized and directed to execute a certain Basement Deed from the City of Bangor to Christopher Hutchins, Trustee of Burgundy Realty Trust, conveying to Burgundy Realty Trust the right to locate, install, maintain and replace concrete pads, gas tanks and signage within the right-of-way at the intersection of pleasant and South Streets, said Basement Deed being on file in the office of the City Clerk. Passed 11 4 _ 92-253 ORDER Title, Directing City Manager to & ecute Easement Deed to CM1r1s[o fier Hutchins trustee of Burgundy realty trust .....{�gro yn/6mp �t,.'-Buuiilldigg egmenc Vu• Aetlpped to _ ilman 92-253 EASEMENT DEED THE CITY OF BANGOR, a municipal corporation organised and existing under the laws of the State of Maine, located at Bangor, Penobscot County, Maine, (Grantor) for consideration paid, releasee to CHRISTOPHER HUTCHINS, Trustee of Burgundy Malty Trust under Declaration of Trust dated July 1, 1988 and recorded in the Penobscot Registry of Heeds Volume 4286, Page 209, (Grantee) an easement for locating, erecting, repairing, replacing and maintaining concrete pads and gas tanks; and building signage for Grantee's building situated at and known as 20 South Street; the location of such pads, tanks and signage being as generally depicted on Schedule A attached. The erection, or replacement of all such pada, tanks and signage shall be subject to prior review and approval by the City of Bangor in accordance with its then applicable ordinances. All signage and replacement signage shall additionally conform to the specifications contained in Schedule B attached. The granting of this eaBenent is pursuant to City of Bangor City Council Order No. 91-291, passed by Bangor City Council July 22, 1991, and further pursuant to Agreement between the Grantor and Grantee dated July 23, 1991. Grantor further grants to Grantee an easement to enter upon land of Grantor, asreasonably required, with me equipment, ataging, fixtures, andmachinery for purposes of repairing, rebuilding, maintaining and servicing Grantee's pads, tanks and sign. The easement herein described shall expire on December 31, 2043.
