Date 5-11-92 V Item No. 92-245 hem/Subject: Authorizing Execution of Municipal quitclaim Deed Real Estate Located at 21 6 27 Everett Street Responsible Department Legal Commentary: In 1984, the Finance Committee authorized the sale of two small surplus lots on Everett Street to Daniel Clarke, an abutting property owner. Apparently as a result of some minor discrepancies between the recorded deed description of the lotsconcerned ned and the City's tax maps, Mr. Clarke never received a deed from the City. Nonetheless, he has been taxed as owner of the two lots since 1984. e It also appears from thCity's available records that a agreed purchase price of $1515.15 was paid by Mr. Clarke prior to March 29, 1984. The City's failure to deliver a deed surfaced recently when Mr. Clarke was contacted by the City's collections clerk regarding payment of outstanding taxes assessed against the two lots. Mr. Clarke has agreed to pay the taxes c ned, but quite reasonably has asked that the.City first supply him with a deed to the property. Councilmen 92-245 The CITY OF BANGOR, a body corporate, located at Bangor, County of Penobscot, State of Baine, for consideration paid, releases to DANIEL G. CLARKE of Bangor, County of Penobscot, State of Maine, all its right, title and interest in and to certain property located in said Bangor and more particularly described as follows: Beginning at a bolt on the southerly line of said Everett Street which is 87.81 feet westerly from the intersection of the southerly line of Everett Street with the westerly sideline of Court Street according to a plan prepared by Prentiss A Carlisle Co., Inc. and recorded in the Penobscot Registry of Deeds in Book 16, Page. 40; thence running south parallel to the westerly sideline of said Court Street 65.69 feet to a bolt; thence running westerly at right angles to the last described line 20 feet to a bolt; thence running southerly and parallel to the westerly sideline of said Court Street 26.77 feet to a bolt in the northerly line of other land of the City of Bangor known a "Coe Park"; thence running westerly along said City of Bangor land 47.49 feet to a bolt; thence running northerly 93.27 feet to a bolt on the southerly sideline of said Everett Street; thence running easterly on and by said sideline 67.16 feet to a bolt at the Point of beginning. Meaning and intending to convey and there is hereby conveyed the same premises described in two deeds to the City of Bangor dated April 24, 1970, the first from John Patrick Barry, and recorded in volume 2182, Page 754, Penobscot Registry of Deeds, and the second from Patricia Anne Griffin, formerly Patricia Anne Largay, and recorded in Volume 2182, Page 756, Penobscot Registry of Deeds. Being the same promises acquired by said John Patrick Barry and Patricia Anne Griffin under the will and Codicil of Patrick J. Byrnes, an abstract of which is recorded in Volume 1559, Page 57, Penobscot Registry of Deeds. The purpose of this Deed is to convey title to the above-described premises pursuant to a sale of the same by the City of Bangor to said Daniel G. Clarke in March, 1984, a deed not having been delivered at that time; and to release any interest of the City of Bangor in the above-described premises arising by virtue of recorded tax liens for the tax year 1990, said tax liens being recorded in Volume 4647, Page 326 and Volume 4647, Page 327. 92-245 The said CITY OF BANGOR has caused this instrument to be sealed with its corporate seal and signed in its corporate name by JOHN QUARTARARO, Finance Director, thereunto duly authorized this _ day of May, 1992.
