Commentary:
It is our intent to conclude negotiations for the
acquisition of the docks prior to Monday evenings City Council
meeting.
In an effort to estimate potential usage of the facility
this season, the attached Setter was cent to previous customers,
and to all owners with registered moorings in Bangor Harbor in
1991.
Staff will be prepared to make a final recommendation
regarding acquisition of the docks and funding sources at or
before Mondays City Council meeting.

ORDERED,
THAT WHEREAS, Bangor Bock Facilities, Inc. has
indicated to the City of Bangor that it no longer intends to
operate it's dock facility; and
WHEREAS, Bangor Dock Facilities, Inc. has offered
the City of Bangor the opportunity to acquire the facility; and
WHEREAS ,it is in the interest of the City of
Bangor to ensure the continued operation of the docking
facility;
NOW, THEREFORE, BE IT ORDERED, BY THE CITY COUNCIL
OF THE CITY OF BANGOR THAT, the Director of Community -
Development is hereby authorised to acquire, on behalf of the
City of Bangor,. in an amount not to exceed $95,000, all floats,
electrical equipment and all related equipment owned by Bangor
Dock Facilities excepting an B foot by 16 foot portable wooden
building; conditioned on the delivery of good and marketable
title and all floats and related equipment, to the City of
Bangor not later than Bay 1, 1992.
BE IT FORMER ORDERED THAT, the Director of
Community Development may expend Urban Development Action Grant
and Community Development funds in an amount not to exceed
$95,000 for the above authorised purpose.

Bangor Dock Facilities offers to sell to the City of
Bangor its property as set forth in the "Bangor Dock Facility
1991 Inventory”, EXCEPT for the S' x 16' Portable building
with S' x 8' outdoor roof overhang.
The sale price shall be Forty-five Thousand Dollars
($45,000.00) to be paid in full at closing subject to the
following condition.
(a) The City's representative and Floyd Marren shall
arrange forthwith to visit the dock facility to assure that
the above-mentioned inventory items are present.
(b). Should any of the inventory items to missing, then
the Seller may deduct from said sales price such reasonable
and agreed upon value of said missing items. Io the event
that agreement isnot reached, then neither Buyer nor Seller
shall be bound to the terms hereof and they may re -negotiate,
if they wish.
Seller agrees as followat
1. Title shall be conveyed by Bill of Sale with title
free of all liens and encumbrances. The City of Bangor shall
deduct at closing the amount of $2,401.79 for personal property
taxes, balance of rent owed for 1991 and State of Maine Submerged
Land Lease fee.

Bangor Dock Facilities, Inc., owner of the docks formerly
operated by Robert Twitchel L, has notified the City that it does not
intend to reinstall the docks in the Penobscot River this boating
season and has offered the City the opportunity to purchase the dock
facility.
The City Council would like to see continued operation of the
facility, but understandably is not aouious to acquire the docks if
operation of the facility would require a City Subsidy. To date we
have been contacted by four boat owners who would commit to renting
space on the docks for the season if the City acquired and operated
the facility. The City needs dock fee revenue from approximately
fifteen boat owners to operate the facility without subsidy.
To assist the City in estimating the demand for dock space, and
the probability of its successful operation without City subsidy, I
am requesting that you contact us am soon as possible, but not later
than April 10th, to let us know if you would rent dock space for the
season from the City. The proposed fee for the season would be $55
to $60 par foot of boat length, subject to approval by the City
Council. We would like to continue to build on the success of public
usage of the waterfront, and your response is crucial to this effort.
