A previous Order has laid out and established the
alteration of Dowd
Road right-of-way. however. it is necessary to
file a separate
Condemnation Order covering the acquisition of
the necessary right-
of-way by eminent domain. As indicated in the
Order,Cdamages in
the total amount of $275.00 are recommended for
the acquisition
of the two earners. This Order isrecommended
for passage. _

ME , WHEREAS, the City Council by Council Order No. 91-167 passed April
S. 1991 hes authorized the City Engineer to lay out and establish as part of the
public way an alteration to the DOW Road right-of-way at the intersection of
Odlin Road{ and
WHEREAS, the City Council has accepted the City Engineer's report relative
to the laying out of said Dead Mad right-of-way alteration: and
WHEREAS, it is hereby determined that public exigency requires the immediate
acquisition of the land necessary to permit the alteration of said Dowd Road right-
of-way as described in the City Engineer's report.
NOW. THEREFORE, Be It _
ORDERED. THAT the City Council of the City of Bangor In its capacity as the
Municipal Officers of the City of Bangor hereby acquires by eminent domain
pursuant to 23 H.R.S.A. 53023 the property interests described as follows:
Land at the northeasterly intersection of Dowd Road and WILL Road
A triangular parcel of land. measuring 25 feet east
along the
northerly right-of-way line of Odlin Mad, and 25 feet north along
the easterly right-of-way lima of Dowd Road, more fully described
as follows:
Beginning at the intersection of thenortherly right-ofway
line of Odlin Road with the easterly right-of-way line of DOW Road:
thence North 79. 09' 14" East along the northerly right-of-way line
of Odlin Mad for a distance of twenty-five (25.00) feet to a point:
thence Potts 59° 21' 58" Wes the southwesterly c of
Lot No. 2 e shown a a Plan entitled 'bawd Industrial Estates",
recorded in the Penobscot Registry of Deeds in Plan File D-193-83
for a distance of thirty-seven and forty-six hundredths (37.46)
feet to the easterly right-af-way line. of Dowd Road( thence South
37° 53' 10" East along said easterly right-of-way line of Dowd goad
for a. distance of twenty-five (25.00) feet to the paint of beginning.

Being•a part of the same premises conveyed to Eremite 6 Valley
by the Bangor Target Area Development Corp. as described in a Deed
recorded in the Penobscot Registry of Deeds in Vol. 3609, Page 189.
Land located at thenorthwesterly intersection Of Dowd Road and Odlin Road
A triangular piece of land, measuring 20 feet x along the
northerly right-of-way line of Odlin Road and 20 feet north along
the westerly right -Of -way line of Dowd Brad, more fully described
as follows:
Beginning at the intersection of the northerly right-of-way
line of Odlin Read with the westerly right-of-way line of Dowd Road;
thence South I9° 09' 14" West along the northerlyyright-of-way line
of gelid Road for a distance of twenty (20.00) feet', thence North
30' 38' 02" Bast for a distance of twenty-six and forty-nine hundredths
(26.49) feet to a point 0n the westerly right -0f -way line of Dowd Road;
thence South 17' 33' 10" East along the westerly right-of-way line of
Dowd Road for a distance of twenty (20.00) feet to the point of
beginning.
Being a portion 0f Lot No. 13 as shown on a Plan entitled
"Dowd Industrial Estates", recorded in Penobscot Registry of Deeds
In Plan Pile D-193-83, and being part of the sees premises conveyed
to Daniel A. Buchanan and Craig C. Poole by a Deed dated August ),
1991 from Maine Aire Protection Systems, Inc., recorded in said
Registry of Deeds in Vol. 4888, Page 32.
Md be it further
ORDERED, THAT the City Council hereby determines that the amount
of damages as just compensation for the interests therein taken are as
f0130wa:
Eremita a Valley, $150.00;
Daniel A. Buchanan and Craig C. Poole, $125.00; and be it further
ORDERED, THAT the City Engineer be and hereby is authorized to take
all further action as required by law to complete the condemnation and
acquisition of said property interests by said City of Bangor.
