Penobscot Valley Refuse Disposal District

Commentary:
The Penobscot Valley Refuse Disposal District has previously
conducted its business with a majority of the total member communities
constituting a qua; however, 1t bas been determined that the state
Statutes also require that a majority of the Directors be present, in
other wards, with a total of 30 communities, 16 communities must be
represented, and at least 31 out of 60 Directors Are also required
to bepresent. The changewould allow business to be conducted if
as few as 16 Directors, one from each member community. are present.
The total number of representative v will not charge. For
ample, Bangor, becauseof itsgre r population, is allowed ) votes,
and 1 Director can cast three votesgta

TEAT , MEMBERS, the By -Laws of the Penobscot Valley Refuse Disposal
District provide that each member community be represented by two Directors:
and
WHEREAS, Title 38 $1701, M.R.S.A., the Refuse Disposal District
Enabling Act. requires that the attendance of a majority of the appointed
Directors, as sell as a majority of the member communities. is required
as a quorum for District meetings. and
WHEREAS, it has been found to be difficult to have a majority of the
total number of Directors in attendance at District meetings, although
a majority of the member communities are usually represented; and
WEREAS, a majority vote of all of the member communities of the
District has approved an amendment to the By -Laws which would reduce the
number of Directors representing each community from 2 to 1, while still
retaining the number of votes corresponding to the level of .population
of the member community. and
WHEREAS, said change in the By Laws also requires the approval of
the voters or the elected officials of each member community;
NOW, THEREFORE, Be It
ORDERED, TEAT the City Council endorses the reduction of Directors
from 2 to 1: and be it further
ORDERED, THAT James D. Ring be and hereby is designated as the Director
representing the City of Bangor, with Jane Heal and Robert Farrar continuing
as Alternate Directors as previously approved by City Council order No. 92-69.
