Comnunury:
The Planning Board held a public hearing on the above noted zoning amendment
at its regularly eeheduled meeting of December 21, 1993.
No one spoke either in favor of or in opposition to the
zoning amendment.
Condition No. (2) any mended to clarify the intent and
the City Council should
amend this order by substitution to reflect this change.
The Board voted 5 to 0 in fever of a motion to recommend to the City Council
that C.Q. H 94-42(Aa Amended) be approved.

Commentary:
For. Referral to Pla,nixig Board
The recent Proposal by Sea Dog Braving Compamy for the Viner Building, has
raised the question of how to treat limited manufacturing operations (when
conducted in Cwyunction with a retail operation) from a zoning ordinance
standpoint.
After reviewing the Waterfront Development District provisiona, City Staff
had developed an amendment to the District regulations which would permit
limited manufacturing ase conditional. use provided that an application
met certain criteria. This would permit the City to consider a variety of
rafts and local produced products including. the proposed Sea Dog Brewevy.
It should be noted that similar Provieiosnhave been previously contemplated.

THAT, Chapter VIII, PART III - Article 14, Section 7 of the.
Laws and Ordinances of the City of Bangor be amended by adding
the following:
D. The assembling, processing, packaging, crafting o
manufacturing of Maine grown crops or items or products
handcrafted wholely within the State of Maine including
small boats up to 35 feet in length provided:
(1) Such assembling, processing, packaging, or
manufacturing process is at least partially open
to viewing by the public.
(2) Such activity will create no adverse off-site
impact by reason of obnoxious fumes, excessive
noise or air borne particles to be generated by
the proposed use.
(3) Such activity does not utilize in excess of 20,000
square feet of building floor area.
(4) Products manufactured or processed on the site are
available for sale and/or consumption to the
public on the premises as part of the activity
approved under this section.
(5) The sales and/or other related activity occupy
floor area within the building equal to at least
25% of the floor area allocated to the
manufacturing or processing use.
