The Planning Board at its meeting of December 9, 1993, held a publin hearing
on the above-noted ewe change request.
Sohn Largay, of S. P. Singleton, Co., represented the applicant and spoke
in favor of the proposed zone change request. No one spoke in opposition.
The Planning Board voted 5 to 0 in favor of a motion to x gamed to the
City Conseil that the zone change request contained in C.O. # 94-19 (As Amended)
be approved.
NOTE: 94-19(As "ended) was amended to reflect an error in the square
footage of the parcel to be changed.

Commentary:
For Referral to Planning Hoard.
Applicant is proposing to change the zoning on two parts of a parcel of lend
located on Pushaw Road. The first part to be changed from Neighborhood
Service District to Rural Residence and Agricultural District and the other
Seat to be changed from Rural Residence and Agricultural District to
Neighborhood Service District.

PUBLIC HEARINGS
Item No. 2: Amending the Land Development Code - 309 Pushaw
Road - Key Financial Services Inc. - C.O. # 94-19
a. General Description. Applicant requests aechange for a

650 square foot area from Rural Residence and Agricultural
(RR 6 A) District to Neighborhood Service District (NSD) and
for a 650 square foot area from NSD back to RR S A. The
commercially zoned area (10,000 sq. ft.) is part of a larger
14 acre parcel zoned RR a A located at the corner of
Broadway and Pushes Road. The proposed zone change would
not increase the total area of NSD zoning on the parcel.
Currently, the parcel has four homes built on it. The
rezoning would allow the applicant to subdivide the parcel
into four separate lots and provide each lot with the
required frontage in the RR 6 A while still maintaining the
minimum 10,000 lot area required in the NSD.
b. Land Use and Zoning Policy. The Comprehensive Plan's Land
Use Concepts and Zoning Policy Maps indicate that this area
should be reserved for rural development. Because the
applicant does not propose to increase the NSD zoning over
what is existing, the proposed zone change is neither more
or less consistent with the Comprehensive Plan.
C. Urban Services. The proposed parcel is outside the Primary
Service Area.
d. Existing Conditions. Currently, there are four dwelling
nits an this 14 acre parcel. The parcel is surrounded by
vacant and rural residential properties. The property is
surrounded by RR 6 A zoning.
e. Decision Criteria. The primary criteria for a rezoning is
that it must be consistent with the City's Comprehensive
Plan. Because the applicant does not propose to increase
the total area of NSD zoning, the Comprehensive Plan is not
really affected. Staff would recommend that the Planning
Board recommend this proposed zone change to the City
Council.
