Commentary: -
MOT will soon be advertising for bids for the reconstruction of
the Odlin Road / as®ond Street / I-395 intersection. It 1s likely
that construction vehicles will need to vel on some city streets
to transport equipment and materials in the vicinity of the project.
MOT has proposed to include a special provision in the construction
contract requiring contractors to obtain permit from the City of
Bangor to use City streets for these purposes. The special provision
would also allow the City to require 8contractor's bond of up to
$15,000/mile to c r damage to City streets. This Council Order
authorizes the City Manager to execute an agreement with MOT
relative to the special provision. Copies of the proposed agreement
and special provisions are attached. _

TWT , the City Manager, on behalf of the City of Bangor, is authorized
to execute a Permit with the Maine Department of Transportation regarding use
of municipal roads for construction vehicles in conjunction with the odlin
Road / Hammond Street Intersection Reconstruction Project. (MOT Project
No. IM -395-8 (97) ).

The undersigned Municipal Officers of the City of Bangor agree that
a permit will be issued to the Contractor for the purpose of hauling
loads in excess of the limits specified in Title 29, M.R.S.A. an
municipal roads as described In the "Construction Area" and that
single move permits will be Issued for moving Contractor's
construction equipment used on the project which exceeds the legal
limits (backhoes, bulldozers, etc.) to sources of construction
materials over municipal ways reasonably within the area of the
project.
In the event that it is necessary to transport gravel, borrow or
other construction material in legally registered vehicles carrying
legal loads over municipal ways, a Contractor's Bond of not more
than Fifteen Thousand Dollars ($15,000.00) per mile of traveled
length may be required by the municipality; the exact amount of said
bond to be determined prior to use of any municipal way.
The maximum speed limit for, trucks on any municipal way will be
twenty-five (25) miles per hour unless a higher Segal limit is
specifically agreed upon, in writing, by the Municipal officers.

SPECIAL PROVISION
CONSTRUCTION AREA
A Construction Area located in the City of Bangor has been
established by the Maine Department of Transportation in accordance
with the provisions of Title 29, Section 1703, Maine Revised Statues
Annotated. The area is described as follows:
(a) The section of highway under construction from Sta. 20+22 to
Ste. 33+00 of the construction centerline, plus approaches..
(b) P.A.B. 1590 (Industrial Spur) from Sts. 20+32 to Sta. 33+00
of the construction centerline, plus approaches.
The State Department of Transportation or the State's Engineer may
issue permits for stated periods of time for moving construction
equipment without loads, low -bed trailers with overloads,
over -height, -width or over -length equipment or materials over
all State maintained sections described in the "Construction Area
above and in addition may issue permits for stated periods of time
for moving overweight vehicles and loads over the section described
In (a) above. The right to revoke such a permit at any time is
served by the State Department of Transportation and the issuance
of such permits shall be subject to any Special Provisions or
Supplemental Specifications written for this project.
A Temporary Permit forach move may be issued by the State
Department of Transportation or the State's Engineer foxmoving
Contractor's construction equipment used the project which
exceeds the legal limits (shovels, bulldozers etc.) to sources of
construction material over highways maintained by the State
reasonably within the area of the project.
