HomeMy WebLinkAbout1993-09-13 93-424 ORDERCOUNCIL ACTION Item No. 93-424 Date September 13, 1993 Item/Subject: Authorising Execution of Municipal Quitclaim Deed -- Real Estate Located at 4 Union Street Responsible Department: Legal Commentary: In February, 1992, the City recorded two corrected tax lien certificates at the Penobscot Registry of Deeds to correct liens previously recorded with respect to property located at 4 Union Street owned by Felix G. Realty Trust. The original lien certificates related to the City's 1991 real estate tax and downtown development district assessments, and recited that the amounts concerned had been assessed against David F. Giroux, as owner of the property concerned. The corrected lien certificates reflected that the property was owned by Felix G. Realty Trust. Mr. Giroux is the trustee of Felix G. Realty Trust. The 1991 tax and downtown assessment was paid in Novesber, 1992, three days prior to foreclosure of the City's corrected lien _ certificates. The discharge certificates were duly recorded at the Penobscot Registry of Deeds. However, the corrected lien certificates were not discharged. The corrected lien certificates are now beyond the statutory foreclosure date under Title 361 HRSh Sec. 943. The attached Order would authorize execution of a municipal quitclaim deed releasing the City's interest arising under the corrected lien certificates for FY 1991 taxes and development district assessments. Because these taxes and assessments have been paid, the Council's approval of this item is requested. 93-424 Amigned to Commlor Cohen, September 13, 1993 CITY OF BANGOR Authorizing Execution of municipal Quitclaim Deed (TITLE.) (Drurr -- Real estate Located at 4 Union Street By the city Coaaeit Of 9w CRY of Beazer: ORDRRRD, THAT John Quartararo, Finance Director, is hereby authorized and directed, on behalf of the City of Bangor, to execute a Municipal Quitclaim Deed, in a form approved by the City Solicitor, releasing any interest the City may have in the real estate located at 4 Union Street in said Bangor by virtue of undischarged Corrected Municipal Tax Lien Certificates recorded against the above-described property in Volume 5003, Page 96 and Volume 5003, Page 97, Penobscot Registry of Deeds. Said Dead shall be directed to Felix G. Realty Trust, as owner of the property.
