TUT WHEREAS, the City of Bangor has provided transit
planning services to the Regional Transportation Organization
known officially as the Bangor Area Comprehensive Transportation
Study Policy Committee;
WHEREAS, the City Planning Division provides the services to
BACTS under an annual contract;
NOW THEREFORE BE IT ORDERED BY THE CITY COUNCIL OF THE CITY
OF BANGOR THAT the City Manager be authorized to sign the annual
Transit Planning Contract between BACTS and the City of Bangor.
STATEMENT OF FACT: The Planning Division provides transit
Planning srs to BACTS for Which the Department of
Community and Economic Development is reimbursed on an
hourly basis plus overhead. This contract remuneration
ration is
budgeted at $30,000 for the upcoming fiscal year in the
Department's Budget.

CONTRACT FDR TRANSIT PLANNING SERVICES
THIS AGREEMENT made this 8th day of June, 1993, by and
between the Bangor Area Comprehensive Transportation Study
Policy Committee, as
a legally established local government
agency (hereinafter referred to as "BACTS") acting by and
through its Policy Committee Chairman, its duly authorized
representative, and the City of Bangor, State of Maine
(hereinafter referred to as "The City"), 73 Harlow Street,
Bangor, Maine.
WHEREAS, BACTS has entered into a contract with the
State of Maine through the Maine Department of Transportation
for the receipt and utilization of certain planning grant
fonds forUrbanized Transit Planning; and
WHEREAS, the BACTS Policy Committee had voted to accept
a proposal from the City of Bangor. for "Proposed Technical
Assistance" for the "Unified Work Program - Transit Elements"
dated March, 1984, and wishes to continue under those terms;
NOW, THEREFORE, the parties hereto mutually agree as
follows:
Sec. 1 Statement Of „Purpose.
The purpose of this agreement is to provide
technical assistance to the Bangor Area
Comprehensive Transportation Study by the City
for Unified work Program - Transit Elements
and to state the terms, conditions, and mutual
understandings of the parties as to the manner
in which these services will be undertaken and
completed.
Sec. 2 Sfppe of Project
The city shall provide staff assistance for
transit Planning to BACTS in the areas
identified in the FY 1994 Transit Elements of
the Planning Work Statement. This will
include necessary data gathering and analysis,
support of the BACTS transit consultant
contracts, coordination of the preparation of
the Transit Planning Work Program Elements to
fulfill the UNTA and RUDY requirements under
the Transit Elements of the BACTS Unified
Planning Work Program. The City will provide
this Staff assistance through the Division of
Planning of the Department of Community and
Economic Development under the direction of
the Planning Officer.
Sec. 3 Products.
A. The Transit Planner will prepare a report
analysing fixed route conditions.
B. The Transit Planner will prepare reports
on ridership surveys as requested.
C. The Transit Planner will assist in
preparation of grant applications a
needed, prepare monthly, quarterly and
annuall progress reports, assist in the
preparation of planning documents
including the TIP/AE and PWS, and document
records for the Area Transportation
Committee.
D. The Transit Planner will perform Short
Range Transportation Planning activities
as identified in the FY 1994 Planning Work
Statement.
B. The Transit Planner will supervise and
prepare narratives of subcontracted
transit studies.
Sec. 4 Period of Perfgrmance.
The City shall commence, rry o and complete
the required technical a assistance to BACTS
with all practible dispatch in a sound,
economical, and efficient manner. The time
period involved in this Agreement starts at
its approval date and continues until June 30,
1994.
Sec. 5 Compensation.
The cost of services included in this
Agreement will be billed to BACTS at the
hourly compensation rate of the various
employees and a fringe benefit and indirect
cost charge asm unting to .5589 of the basic
rate (based on City of Bangor City -Wide Cost
Allocation Plan prepared by Peat, Harwich S
Mitchell and co. for 1982). In addition,
out-of-pocket costs for any printing,
materials or mileage (at .22 per mile) will be
billed to BACTS. The City will maintain
adequate records of time devoted to this
activity and shall permit the State
comptroller General of the united States
Department of Transportation, or their duly
authorised representatives to have access to
and audit the books, records, and accounts of
the City pertaining to this activity. The
cost of such service for the fiscal year
ending June 30, 1994 is not to exceed
$40,OOD.00.
Sec 6. Cgmpliagge Atte state and Federal_ eegpirements.
The City shall comply with the requirements of
the third party agreement between BACTS and
the State of Maine Department of
Transportation for Urbanized Transit Planning
as to any interest in this contract by members
of/or delegates to Congress or or by members,
officials, or employees of the State of Maine
and s to compliance with equal opportunity
and the requirements of Title vi of the civil
Rights Act of 1964.
Sec. 7 contract Changes.
This Agreement may be modified by the mutual
consent of the parties at any time. The BACTS
Policy Committee may, by a written notice to
the City, terminate this activity and cancel
this Agreement provided that the City will be
reimbursed for work satisfactorily performed
prior to the date of the termination.
Sec. a effective. pate.
This Agreement shall. become effective on July
1, 1993.

Agreement to he executed and attested by their duly
authorized Officers on the date and year first above written.
