Item No.
Data June 14, 1993
Item/Subject: Authorising Execution of Municipal Quitclaim Deed
-- Real Estate Located at 176 Fountain Street
Responsible Department: regal
In August, 1992, Charles M. and Anne T. Sias paid off in full
amounts owed to the City of Bangor on tax account no. RE 60533
located at 176 Fountain Street, by virtue of a matured real estate
tax lien recorded by the City in My, 1990. No quitclaim deed was
issued, however, because the Siases neglected to pay the City's
additional $50.00 quitclaim dead fee. Prior to August 1992, Kr.
and Kra. Sias had sold their property to John N. and Susie R.
Vogell. In September, 1992, Peoples Heritage Bank obtained a
foreclosure judgment against the Vogells under a mortgage they had
given at the time the property was purchased by them. Peoples
Heritage subsequently purchased the property at its own foreclosure
sale.

Recently, the lack of a quitclaim deed turned up during a
title search done by local attorney Gary Morton in connection with
a sale of the property by Peoples Heritage. On Peoples' request
and upon payment of the $50.00 quitclaim deed fee, the City Finance
Director executed and recorded a Municipal Quitclaim Deed, copy
attached, to enable the property sale to close on the originally
scheduled date. This Order would ratify the Finance Director's
action. The Council should be aware that the purchaser of the
property concerned 1s Assistant City Solicitor Bruce Shibles. The
Council should also be aware that the Finance Director's action in
this matter is consistent with the City's current policy and
practice in issuing quitclaim deeds upon payment of matured tax
liens.
