Commentary:
This item has been requested by the police Department. The
computer concerned was part of a larger Beizure in connection with
a distribution of marijuana cases. The City has previously
received title to an automobile, forfeited funds, and other
Property seized as part of this particular investigation. The
computer equipment is being processed separately because the former
owner bad contested whether it was subject to seizure. That
question was decided by Order. of Sueprior Court Justice Andrew Mead
entered February 5, 1993 in docket no. CV -92-140. By prior
agreement with the Penobscot County District Attorneys, office, the
computer equipment represents the DA's portion of the total
seizure.

ORDERED,
the City of Bangor Police Chief is hereby
authoiTdied in accordance with 15 MRSA S 5824 (3) to accept, in
behalf of the City of Bangor, a Macintosh computer and related
equipment forfeited to the State of Maine under 15 MRSA 5 5821.
AND BE IT FURTHER ORDERED THAT upon acceptance of the
forfeited equipment, the Police Chief is authorized to transfer the
same to the Penobscot County District Attorney's Office.
