Cammemzry:
The City of Bangor has acquired property at the southwesterly
end of Opening Road for future Airport expansion (C.O. 92-492 passed
10/26/92). As a result, the southwesterly end of punning Road is
o Langer needed as apublic way. This Council Order authorizes
discontinuance of the portion of Downing Brad within the area
of
proposed Airport expansion. A sap. is attached which shows the
location of the proposed discontinuance.

MT . WHEREAS, the City of Bangor has recently acquired property at
the southwesterly and of Downing Road for the future expansion of Bangor
International Airport; and
WHEREAS, said Airport expansion will include the southwesterly portion
of the existing right -of -wry of Downing Boat: and
WHEREAS, the continued use of said portion of Downing Road as a public
street is not considered necessary to serve the public need;
NOW. THEREFORE. Be It
DUERgO, THAT the City Engineer, acting for and on behalf of the
Municipal Officers a ording to law, be and hereby is authorised to dis-
continue said portion of Donning Road, which is more fully described as
follows::
Beginning at a 06 steel rebar set in the northwesterly line of the
Dowing Road at a point two thousand five hundred twenty-five (2,525) feet,
more r less, from the intersection of the northwesterly side of the Downing
Asad with the southwesterly line of Union St. (formerly Valley Ave.), said
k6 steel rebar defining the southeasterly cutter
of the parcel described in
a prior deed from Charles W. Sprague, Jr. t the City of Bangor dated July 1,
1991 and recorded in the Penobscot Registry of Deeds in Volume 6866, Page 76;
thence S 36' 09' 00" W by and along the northwest side of Downing Road
three hundred seenty-six and ninety-nine one hundredths (3)6.99)-feec t
a point; thence N 53' 51' 00" W twenty-five (25) feet to a point; thence
5 36' 09' 00" W ninety-nine and thirty-eight one hundredths (99.38) feet
to a point; thence S 45' 35' 31" E one hundred twenty-one and twenty-five
e hundredths (121.25) feet is a point; thence N 36' 09' 00" E one hundred
seventeen n
and sixty-three one hundredths (117.63) feet to a point; thence
N53' S1' 00" W twenty-five(25) feet to a point; thence M 36' 09' 00" E
by and along the southeast side of the Downing Road one thousand two hundred
thirty-six and fifty-four one hundredths (1,236.54) feet to a point; thence
N 55' ll' 15" W seventy and two one hundredths (70.02) feet to a point on
the northwest side of the Downing Road; thence S 36' 09' 00" W by and along
the northwest side of said Dowing Road eight hundred fifty-eight and sixty-
five one hundredths (858.65) feet tothe point of beginning.

Meaning and intending to describe a portion of the 70 foot aide
right-of-way of Dowing Road as originally Said out and accepted as a
public way by the City of Bangor on January 19. 1945; and be it further
ORDERED, TMT the City Engineer, in accordance with the provisions
of 23 M.R.S.A. 4 3026, proceed to give best practicable notice to all
abutting property owners and to the planning Board of the Intention of
said Municipal Officers to discontinue and vacate said right-of-way,
and make a written return of said proceedings, together with a list of
damages as a result of said discontinuance, and report his findings to
the City Council for further action.
