This Order authorizes the City Manage[ to execute a standard
Local/State Agreement with M.D.O.T. for intersection improvements
at Calla Hoad/Maine Ave./Hammond Street. (Federal Aid Project No.
STP -1560-4195 (11) / P.I.N. 4195.11). Estimated project cost is
$40,000.
The Agreement provides for payment of the Local Share of 155, and
includes the customary
omary language regarding future maintenance of
the improvements by -the municipality. A copy of the Agreement i
attached. M.H.O.T, anticipates advertising foructioh bids
in April. This project was developed through the DACTS process
and has been in the planning stages for approximately two years.

`TUT Edward A. Barrett, City Manager, is hereby authorized to cute
e Mualclpal/State Agreement with the State of Maine Department of Transportation
for intersection improvements at the intersection of odlin Road, Maine Ave
and Happened Street. Me Agreement provides for payment of the Local Share of
15% of the project costs by the City of Bangor to the State of Maine. The
Local Share is estimated to be $6.000.00.

AND THE
CITY OF BANGOR
REGARDING
PROPOSED TRAFFIC SIGNAL INSTALLATION
INTERSECTION OF ODLIN ROAD, MAINE AVENUE & HAMNOND STREET
FEDERAL AID PROSECT NO. STP-1560-4195(11)/PIN 4195.11
This AGREEMENT is made this day of I, 19 ,
by and between the STATE OF MAINE, acting by and through its
Department of Transportation, hereinafter referred to as the State,
and the CITY OF BANGOR, in the County of Penobscot, a body corporate
and politic, hereinafter referred to as the City;
WITNESSETH, that
WHEREAS, the State is planning to install a fully -actuated traffic
signal at the intersection of Odlin Road, Maine Avenue and Hammond
Street in Bangor, and;
WHEREAS, the City desires such installation, and;
WHEREAS, the proposed installation requires agreement between the
parties hereto regarding cost sharing and certain operational and
maintenance responsibilities;
NOW THEREFORE, the parties agree as follows:
I. The State agrees to the following:
A. To install a fully -actuated traffic signal at the location
hereinbefore described under its Federal Aid Project No.
STP-1560-4195(11)/PIN 4195.11, hereinafter referred to
s the project.
B. To include asa part of the project all necessary pavement
markings and traffic control signs appurtenant to the
traffic signal on a first time basis.
C. To allow the City to request changes or additions to the
project at any time following the completion of design and
advertising for bids and to make all approved changes and
additions inaccordance with and subject to the provision
hereinafter set forth under Section 11, Paragraph B.

II. AND the City agrees to the following:
A. To pay to the State upon receipt of an invoice immediately
following contract award, a lump sum payment towards the
cost of the project based 15% of the LOWER of the two
coat estimates set forthbelow, to wit:
1. The estimated total cost of the project, including all
engineering and right of way costs, as determined from
a detailed estimate prepared upon completion of the
project development process just prior to advertising
for bids, or
2. The estimated total cost of the project, including all "
engineering and right of way coats, as determined from
the detailed estimate updated at the time of contract
and with the bid prices contained in the construction
contract.
B. To pay to the State any additional construction cost
resulting from any approved changes or additional work
which may be hereafter requested by the City pursuant to
the provision set forth under Section I, Paragraph C
above, plus 10% to cover engineering and overhead costs.
All requests for changes or additional work shall be made
in writing to the State's Construction Division
acknowledging the willingness to pay such cost. In the
ant that approval is obtained for federal participation
n the cost thereof, the additional coat may be reduced to
,the non-federal share of such additional cost.
C. To operate and maintain at its o expense the traffic
signal described herein and perform all required
maintenance in the following manner.
1. To expeditiously correct o repair all deficiencies or
malfunctions in the si.gnalas required.
2. To preserve the visibility of the signal by causing all
visual impairments to be removed.
3. To return the signal and all related equipment when
moved and replaced to the State without cost to the
State. The State shall be notified immediately upon _
such removal and replacement.
D. To maintain at its own expense all pavement markings and
traffic control signs included as a part of the project.

duplicate on the day and year first above written; the STATE OF
MAINE, acting by and through its Department of Transportation, by its
Commissioner, hereunto duly authorized, and the CITY OF BANGOR,
acting by and through its City Manager hereunto duly authorized by
its City Council onI
