HomeMy WebLinkAbout1992-12-28 93-68 ORDERCOUNCIL ACTION Item No. 93-68 Date December 28. 1992 Item/Subject: Authorising Execution of Municipal Quitclaim Deed -- Real Estate Located at 236 Birch Street Responsible Department: Legal Commentary: The purpose of this Order is to release any interest the City may have in the real estate described in the Order by virtue of an undischarged municipal tax lien on record in the Penobscot Registry of Deeds for the year 1969. At the time the taxes were paid in 1973 a deed was given to the taxpayer. Apparently, the deed was either lost or destroyed and never recorded in the Registry of Deeds. John Quarta;aro, Finance Director, is hereby authorized and directed, on behalf of the City of Bangor, to execute a Municipal Quitclaim Deed, a copy of which is on file with the City Clerk, releasing any interest the City may have In the real estate located at 236 Birch Street in said Bangor by virtue of an undischarged municipal tax lien assessed against the above-described property for the tax year 1969. Said Deed shall be directed to Patricia M. Leighton, formerly Patricia Clark, successor in title to James B. HN -"✓'" f-1:99.HhR. .............an - councilman MUNICIPAL OUITCLAIM DEED The CITY OF BANGOR, a body corporate, located at Bangor, County of Penobscot, State of Maine, for consideration paid, releases to PATRICIA M. LEIGHTON (formerly Patricia Clark), of Bangor, Penobscot County, State of Maine, all its right, title and interest in and to certain property located in said Bangor and more particularly described as follows: Beginning at a point on the westerly side of Birch Street and fifty-eight (58) feet north of the southerly line of lot numbered 84 as laid down on a plan of Fred H. and P. Lob. Coombs, dated May 25, 1868 and recorded in the Penobscot Registry of Deeds in Plan Book No. 2, Page 49, December 15, 1868; thence northerly and in the westerly line of Birch Street fifty (50) feet to a point; thence westerly and at right angles one hundred (100) feet to a point; thence southerly and narallel to the westerly line of Birch Street forty-eight (48) feet to the northerly line of said lot numbered 84; thence westerly and at right angles thirty-two (32) feet to a point; thence southerly and parallel to the westerly line of Birch Street two (2) feet to a point; .thence easterly and parallel to the northerly line of said lot numbered 84 one hundred thirty-two (132) feet to the point of beginning; being a part of lots numbered 84 and 86 as laid down on the above mentioned plan; also being a part of the same premises conveyed by James H. Lynch to Catherine Lynch by deed dated December 1, 1899 and recorded in said Registry of Deeds in Vol. 694, Page 101; the said Catherine Lynch having died intestate March 11, 1906 leaving no widower and as her only heir-at-law and next of Rin, James H. Lynch. Being the same premises conveyed to James H. Clark, Jr. and Patricia Clark by deed of James H. Lynch, dated October 1967 and recorded in the Penobscot County Registry OfDeeds n volume 2118, Page 467. Further reference may be had to deed of James H. Clark, Jr. to Patricia Clark, dated September 17, 1975 and recorded in said Registry in Volume 2585, Page 158. The girpose of this dead is to release any =newest the City may have in the above-described property by virtue of an undischarged municipal tax lien assessed against the property for the year 1969 and recorded in Volume 2184, Page 534, Penobscot Registry of Deeds. The purpose of this Deed is to also replace a previous Quitclaim Deed given by the City of Bangor dated march 21, 1973,.said Deed: either being lest or destroyed and not recorded in the Penobscot Registry of Deeds, The said CITY OF BANGOR has caused this instrument to be Baled with its corporate seal, and signed in its corporate name by JOHN QUARTARARO, Finance Director, thereunto duly authorised, this day of December, 1992.
