HomeMy WebLinkAbout2018-01-08 18-082 ORDINANCETitle, Ordinance 18-082 01/08/2018 CITY COUNCIL ACTION Council Meeting Date: January 8, 2018 Item No: 18-082 Responsible Dept: Code Enforcement Action Requested: Ordinance Map/Lot: N/A Amending Chapter 165, Land Development Code, Section 165-116, by Allowing Reductions in the Number of Parking Spaces as Minor Revisions to Existing Land Development Permit Plans Summary This ordinance amendment would allow the number of parking spaces designated on an approved site plan to be reduced as a minor revision to the plan, as long as the number of spaces does not fall below what is required under the Land Development Code. At times, a developer or property owner applies for approval of a site plan with proposed parking in excess of what the Land Development Code requires. At present, if the developer later decides it does not wish to construct some or all of the excess parking, the developer must go back to the Planning Board in order to delete the excess, non -required parking from the plan. This proposed change would allow the developer or owner to receive permission to remove excess parking from the plan after review and approval by the City Engineer, Planning Officer and Code Enforcement Officer. The proposed amendment would reduce the processing and review time of some applications and save on processing and consulting fees for the developer and owner. City Manag City Solicitor Finance Director Introduced for: First Reading and Referral CITY COUNCIL ORDINANCE Date: January 8, 2018 Assigned to Councilor: Tremble 18-082 01/08/2018 ORDINANCE, Amending Chapter 165, Land Development Code, Section 165-116, by Allowing Reductions in the Number of Parking Spaces as Minor Revisions to Existing Land Development Permit Plans WHEREAS, from time to time, land development permit plans are approved with proposed parking in excess of what the Land Development Code requires; WHEREAS, at present, if the developer later decides it does not wish to construct some or all of the excess parking, the developer must go back to the Planning Board in order to delete the excess, non -required parking from the plan; WHEREAS, removal of unwanted parking spaces that are not required under the Code is better accomplished as a minor revision to the plan in question; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BANGOR AS FOLLOWS, THAT Chapter 165 of the Code of the City of Bangor is amended as follows: § 165-116 Minor Revisions. Minor revisions to approved development plans may be permitted by the Code Enforcement Officer subject to the following conditions: D. Minor revisions to land development permit plans may be approved by the Code Enforcement Officer, provided that such minor revision will not materially alter the layout or scale of the development nor its impact on its surroundings, nor will it specifically: (5) SianificantlX alter on-site vehicular circulation.
