HomeMy WebLinkAbout1994-04-25 94-189 ORDINANCECOUNCIL ACTION Item No. 94-189 Date April 25, 1994 Stem/Subject: Amending Chapter VII, Article 11 of the City Ordinances -- Licensing and Control of Dogs Responsible Department Legal Commentary: The attached item would am end Chapter VII, Article 11 of the City's Ordinances, pertaining tolicensing and control of dogs, to require all persons owning or ontrolling a dog in the City of Bangor to clean up and remove any feces deposited by their dog on others' property. As drafted, this item is modeled after a current City ordinance provision, in Chapter VI, Article 12, requiring persons owning o controlling a dog to clean up after their dog when i City parks. The proposed ordinance amendment would apply City-wide to all properties, both public and private. An exception is provided where the person owning or controlling the dog concerned nrned- is unable to comply with the clean-up requirement due to aphysical handicap. A minimum fine of $100 is provided for violation of the ordinance. Shubert 6 Stili 94-189 Statement of Fact: Underlines are additions, esesseuts are deletions. A former Section 5 was repealed by C.O. 83-115 and referred to dogs running at large. The intent of the new Section 5 is to require persons owning, keeping or exercising dogs to clean up dog feces deposited by their animals from all property within the Bangor municipal limits, unless the property concerned is owned or leased by that person. An exception is made for handicapped individuals who are physically unable, because of their handicap, to clean up after their dog. A minimum penalty of $100 is established for each violation.
