Recently, the State seized a firearm in conjunction with a drug
search. The Penobscot County District Attorney's office has
proposed that the firearm, a Harrington 6 Richardson 12 gauge
Shotgun, Topper Model 58, serial W218046, be awarded to the
Bangor Police Department for its investigation and assistance in
the case. The attached Council Order would authorize the
acceptance from the State of Maine to the City. Prior municipal
approval of the acceptance is required under 15 MRSA S 5824(3).

by the City of Bangor in accordance with 15 MRSA g 5821(3-A).
Said firearm shall be disposed of in accordance with state law
and any further Orders of the Maine District Court. The City
Solicitor is authorized to execute all necessary documents
reflecting municipal acceptance of the forfeited firearm for.

Enclosed please find a copy of the order, copies of police
reports, and Consent of the Municipal officials form for your
signature.
This forfeiture action concerned a firearm which was seized
from the Defendant, along with a a marijuana. Since the Bangor
Police Department investigated this case, we propose that the
Department receive the firearm. Please present this matter to
the City Council so that the firearm can be transferred to the
Bangor Police Department. Please return the form to me for
filing with the Court.
Thank you for your assistance in this matter. If you need
any additional information, please let me know.

OFFICIALS PURSUANT TO
7 15 M.R.S.A. SEC. 5824(3)

At a meeting of the appropriate municipal officials for the
City of Bangor, Maine, on the _ day of March , 1994, by a
unanimous vote, it was the determination of the City Council
pursuant to 15 M.R.S.A. section 5824(3), to consent to the
transfer of title to One Harrington S Richardson 12 gauge
shotgun, Topper Model 58, serial 8 AN218046, to the city of
Bangor from the above -referenced forfeiture, as the Bangor Police
Department made a substantial contribution to the related lawful
search for Scheduled Drugs in -which .. Scheduled Drugs .were found.
