ORDERED, i
THAT-1RHEREA.S, the City of Bangor filed an application with the
Historic Preservation Commission to remove Bud or demolish some or
all of the Bangor Waterworks buildings; and
WHEREAS, Chapter VII, Article 4 Section 11.2(b) of the
Historic Preservation Ordinance gets forth a condition under which
a Certificate of Appropriateness for such camoval and/or deamolition
shall be approved; and
WHEREAS, under Section 11.2(b) the criteria for such
approval relates to the demonstration by the property caner that it
is incapable of earning an economic return on its value at its
present location; and _
WHEREAS, the City of Bangor presented testimony on past
efforts to redevelop the Waterworks and presented testimony by an
expert real estate appraiser who clearly demonstrated that the
City, as owner of the Waterworks, is incapable of earning an
economic return; and
WHEREAS, the record of the Historic Preservation
Commission deliberations on the City's request does not support the
Commission's decision to deny the application.
THEREFORE, BE IT ORDERED THAT the City Manager is
directed to file an appeal of the Histcric Preservation
Commission's decision to the Zoning Board of Appeals..

HE: Council Action Regarding Bangor Waterworks
DATE: March 9, 1999
At a recent workshop, the City Council requested that options
related to the Historic Preservation Counission's denial of the
City's application, be placed on the City Council Agenda. There
are 2 options on the agenda for consideration. Of course, a third
Option Is to take no action. These options are summarized as
follows:
1. Appealing Historic Preservation Commission's
Decision - The City has the option, within 30 days
of the FSC decision to appeal the decision to the
Zoning Board of Appeals..
2. Resubmitting An Application to NPC - The second
Council Order would direct the City Manager to
submit an application to the HPC for partial
demolition / removal of the waterworks at". As
drafted, this Order would authorize the City to
request permission to remove the Superintendents
House from the site and to demolish up to 7,000
square feet of floor area. The specific location
of the area that might be demolished would not be
determined in the application but in concert with a
development proposal.
3. No Action - The City would take no action and
market the property "as is". An option associated
with this scenario is a change in the historic
preservation Ordinance which would make permitting
partial demolition of a historic property, in
conjunction with a rehabilitation project, lees
onerous and class consuming.
Staff will be prepared to discuss these and any other options
at the Council meeting.
