Commentary,
During recent discussions concerning security/liability
concerns at the Bangor Waterworks, Councilor Stonessed a
question concerning the procedure regarding demolition of the
complex. Hased on this inquiry, City staff have researched and
reviewed information concerning various options for the Waterworks
property. Asynopsis of this research was presented to the
Community and Economic Development Committee on January 5, 1994.
Costs of demolition ($500,000 rough eatimate), long-term
stabilization ($150,000-$2001000 rough estimate), partial
demolition ($100,000 rough estimate), gate house removal ($5,000-
$15,000 rough estimate), complete renovation ($2-3 million rough
estimate), annual security maintenance ($5, 000 rough estimate) were
presented to the Committee. The Committee voted unanimously to
recommend that the full Council authorize staff to seek appropriate
authority from the Historic Preservation Commission to demolish or
remove all or part of the Waterworks complex, and to utilize the'
180 -day time period stated in the Ordinance to further explore
options for the property. Although no Committee member advocated
demolition or removal, the consensus was that the City should have
the ability to act on all options when and if money becomes
available or developer interest shows itself with regard to future
e of this property. Approval will allow this matter to be
considered by the Historic Preservation Commission at its meeting

removal could Occur, assuming all approvals are in place, would be

THAT Edward A. Barrett, City Manager, is hereby authorized,
with the assistance of City staff, to submit an application to the
Historic Preservation Commission which would allow for the
demolition or removal of buildings associated with the complex
known as the Bangor Waterworks. Said application shall seek
from the Commission, pursuant to Chapter VII, Article 4, Section
11.2 of the Laws and Ordinances of the City of Bangor, a Certificate
of Appropriateness which would allow the City to demolish or
remove all or some of the buildings located at the Bangor
Waterworks site.

*11.2 Demolition or Removal. A historic landmark, or any building or
structure in a historic district, or any appurtenance thereto. shall
not be demolished or
moved and a Certificate. of Appropriateness shall
not be approved until either (a) In a historic district such building
or structure has been identified by the Commission as incompatible
with the historic district in whichit is located, or (b) the property
Ownern demonstrate that it is Incapable of earning an economic
return on its value in its present location as appraised by a
qualified real estate appraiser. If such a demonstration can be made,
issuance of a certificate for movement or demolition shall be delayed-

below, have been filed with the Commission. Notices shall be posted
n the premises of the building or structure proposed for demolition
in a location clearly visible from the street. In addition, notice
shall be published In a newspaper of general local circulation at
least three (3) times prior to demolition. the final notice of which
shall be not less than fifteen (15) days prior to the data of the
permit. and the first notice of which shall be published nomore
than fifteen (15) days after the application for a permit. to demolish,
is filed. Prior to the issuance of such certificate for removal, the
Own ers shall stipulate that the proper notices as required had been
posted, that the property was properly offered for sale, that there has
been no bona fide Offers made, and that no contract for sale has been
executed with interested parties. The Owner shall for the period of
time set forth and at a price reasonably related to its face market
value, make a bona fide Offer to sell such building or structure, and
the land pertaining thereto, to any person, .firm. corporation, government
agency thereof, or political subdivision or agency thereof, which gives
reasonable assurance that it is willing to preserve and restore the
building or structure and the land pertaining thereto. Prior to making
h offer to sell, anOwner shall first file a statement with the
Historic Preservation Commission, Identifying the property, the offering
price and the date the offei'to sell shall begin. no time period net
forth in this Section shall net camaze nee until such statement has been
filed. The Purpose of this Section is further the purposes of this
Ordinance by preserving historic buildings which are important to the
education, culture, traditions, and the economic value of the City, and
to afford the City, interested persons, historical societies or organi-
zations the opportunities to acquire or toarrange for the preservation
of such buildings.
