In 1992, the City received a warranty deed to lots numbered 55 and
57 in the Stillwater Gardens subdivision, as security for the
completion of required public improvements in the "Stillwater
Gardens Expansion." The warranty deed was to be held in escrow by
the City, under provisions of a Subdivision Improvement Guarantee
Agreement recorded in Book 4819, Page 280, Penobscot Registry of
Deeds, as subsequently amended.
Although the required public improvements were completed in
accordance with the provisions of the Subdivision Improvement
Guarantee Agreement, the City never returned the escrow deed or
released its interest in the lots concerned. Recently, at the
original developer's request, acting City Manager Ken Gibb executed
a deed releasing the City's interest in the two lots. The City's
deed was executed and delivered i advance of Council approval to
facilitatea scheduled closing on the developer's sale of the lots
cncerned. This Resolve would ratify execution and delivery of the
City's deed. I _

RESOLVED. the action of Kenneth Gibb, Acting City Manager, in
executing and delivering a Municipal Release Dead releasing the
City's interest in lots cantered 55 and 57, Stillwater Gardans
Expansion, to MRS, INC., is hereby ratified and affirmed. A copy
of said Municipal Release Deed is attached to this Resolve, and is
incorporated herein by reference.

MUNICIPAL RELEASE DEED
CITY OF BANGOR, a body corporate located at Bangor, County
of Penobscot, State of Maine, for consideration paid, releases to
MRS, INC. a Maine corporation with offices in Brewer, County of
Penobscot, State of Maine, the following described real estate:
A certain lot or parcel of land, together with build-
ings and/or improvements thereon, and being Lot No. 55
and Lot No. 57 as shown on Final Subdivision Plan of
Stillwater Gardens Expansion, Bangor,. Maine, dated
October 1990, recorded April 29, 1991, in the Penobscot
County Registry of Deeds, Map File D48-91, prepared by
-Civil Engineering Services.

This deed is given to release any interest that the Grantor
may have in said real estate by virtue of a Subdivision
Improvement Guarantee Agreement dated March 6, 1991, and recorded
in the Penobscot County RegistryofDeeds in Book 4819, Page 280,
and a second amendment to said Subdivision Improvement Guarantee
Agreement dated February 21, 1992, and recorded in the aforesaid
Registry of Deeds in Book 5006, Page 276.
The said CITY OF BANGOR, has caused this instrument to be
signed and sealed in its corporate name by Kenneth Gibb
its duly authorized Acting City Manager this 19th day of
September 1994.
