THAT WHEREAS, the City of Bangor, through its Airport Department, has acquired certain real property known as the Maine State Armory building (Armory) located on lower Main Street (Bangor Tax Map R24; Let 5A); and WHEREAS, said property is currently subject to airport self- sufficiency requirements under provisions of the Federal Aviation Act and Federal Aviation Administration regulations implementing the Federal Aviation Act; and WHEREAS; current PAA regulations require that airport property acquired with Federal funds be used to generate rental income at fair market value for the support of aeronautical operations at the airport; and WHEREAS, the City wishes to exchange the Armory for other City real estate located on Essex Street (Naval Reserve Center, Tax Map 46, Lot 63), to make the Armory available for use by the City's Parks 6 Recreation Department, NOW, THEREFORE, By the City Council of the City of Bangor be it ORDERED, THAT the City Manager and City Airport Director are hereby authorized toexecute a um andof Understanding, i a form approved by the City Solicitor, exchanging the former Maine State Armory property located on lower Main Street for the former Naval Reserve Center located on Essex Street, subject to the following requirements concerning use, occupancy and payment of rent: (1) The City's Airport Department shall have the use and occupancy of the Naval Reserve Center, and all rents derived from any lease or other private use of the Naval Reserve Center shall be treated as dedicated revenues oftheCity's Airport Enterprise Fund; s4 -4o2 (2) The City's Parks and Recreation nepartment shall have the use and occupancy of the Armory, and all rents derived from any lease or other private use of the Armory shall be treated a City of Bangor general fund revenues within the Parka and Recreation Department; (3) In each year the Memorandum shall remain i effect, the City shall transfer or credit from the general fund to the Airport Enterprise Fund an amount equal to ten percent (10%) of the difference between the appraised fair market value of the Armory and the Naval Reserve Center, based on the values of the properties established as of the date of execution of this Memorandum) and (4) While the Memorandum remains effect, the Airport Department and the City, through its general fund and capital fund, shall be responsible for all regular and capital maintenance of the Naval Reserve Center and the Armory, respectively.
