ORDERED,
TEAT WHEREAS, the City of Bangor is the owner of the Bangor Waterworks
Complex located at 619-639 State Street in Bangor; and
WHEREAS, the Bangor Waterworks has not been used to provide a water
supply since 1957 and for the generation of hydro -electric power since 1968, and
WHEREAS, for almost two decades the City has solicited proposals and
worked with several developers in attempting to secure redevelopment and reuse of the
facility which bas remained vacant and unused; and
WHEREAS, in May of this year the City issued the most recent Request
for Proposals for redevelopment of the Bangor Waterworks Complex; and
WHEREAS, one proposal was received in response In the Request for
Proposals which has been reviewed and evaluated by the City Council and City staff ;
and
WHEREAS, the proposal received from Anasms & Lohnes, Inc. has met
all the RFP requirements; and
WHEREAS, it is the recommendation of City staff that Anastos & Lohnes,
Inc. be designated as the Tentative Developer of the Bangor Waterworks unfit December
31, 1994; and
WHEREAS, the proposal deserves the full consideration of the City;
NOW, THEREFORE, BE IT ORDERED THAT Anastos & Lobnes, Inc.
of Yarmouth, Maine is hereby designated as the Tentative Developer of the Bangor
Waterworks until December 31, 1994 during which time the Director of Community and
Economic Development is authorized to negotiate an Option Agreement with Anastos &
I.ohnes, Inc. for future consideration by the City Council; and

BE IT FURTHER ORDERED THAT the City staff not solicit or accept
any other oral or written offer for acquisition or redevelopment of the Bangor
Waterworks for consideration by the City Council until negotiations with Anastos &
Lohnes, Inc. are finalized by the Director of Community and Economic Development
and presented to the City Council for its consideration.

Marshall Stern spoke against using municipal money
to help fund the Development Pf a new restaurant
in the city. He urged tabliqgthis order so further

Motion for Passage by Councilor Stone
Second by Councilor Popper.
Fred Vadamis, 22 Newey St., spoke In opposition
of the proposed Development - felt that the City
did not clearly define which buildings would and
would not be torn down.
Elizabeth Woodcock, 58 Baldwin Dr., Number of the
Historic Preservation Commission.. - in favor of
the development. Feels that the opportunity for
this development has been well publicized and this
order is only an ititial proposal.
Larry Mahaney, 500 Main Street, opposed out-of-twawn
developers and using taxpayers money for Project.
Deborah Thompson, ll] Norfolk St., number of the
Historic Preservation Commission, spoke of the
Water Works as an Historic Landmark - Peels saving
it is very important to the Citizens of Bangor.
Noted that many other projects have survived and
prospered with aid from the City.
Peter Calori, 36 Headowbrook Road, believes it's
unfair for any business to ask for subsidy from
the City.
Ren Jordan, representing Anastos d Lohnes, explained
that group was not asking for subsidy. Will pay back
loan in the fore of taxes. City would spend a great
deal of money to tear down Water Works. City would
gain jobs a revenue.
Marshall Stern, atty. for Taxpayer Restaurant Committee,
No are would take building without Tax -Increment Financing
City should not use Tax -Payers money for this purpose.
Peter Anaetos, Muddy Rudder, feels the "Playing Field" is
level and that competition is good for the area.
Bill Lippincot, Bangor Resident - in favor of this
Development.
Bob Mowdry, Bradford Resident - Interested in Development
himself, at one time. Supporta proposed development -
feels Water Works Development could not happen out-of-
pocket.
Dave LaVoie, Moutain View Avenue. favored proposed
Development. Feels opposition doesn't want competition.

MEMORANDUM

RE: Tentative Developer - Bangor Waterworks
DATE: September 7, 1994
At the Monday, September 12 meeting, the Bangor City Council
will consideran
Order designating Anastos & Lohnes, Inc. of
Yarmouth, Maineas Tentative Developer of the Bangor Waterworks
Complex. Approval of this Order will result in the City working
exclusively with Anaetos & Lohnes over the next three months to
finalize negotiations.
This action results from the Request for Proposals (RFP)
process initiated by the City during the spring of 1994. Proposals
for redevelopment of the site were solicited on a local, regional
and national basis. The City received only one responsive
proposal, from Anastos & Lohnes, Inc., by the June 16, 1994
deadline.
Anastos and Lohnes is a building company which has been the
developer of a variety of successful projects in Maine and other
New England locations including several historic properties. Peter
Anastos and Paul Lohnes a also principals of the Maine Course
Hospitality Group which operates nine restaurants and one lodging
facility in Maine, New Hampshire and Virginia. These properties
include the Ground Round restaurant in Bangor, the Freeport Inn and
Cafe, and the Muddy Rudder Restaurant in Yarmouth.
'Anastos and Lohnes and the Maine Course Hospitality Group plan
to develop a 250-275 seat full service Muddy Rudder Restaurant at
the Waterworks site. The restaurant will promote the historical
nature of the Waterworks and its waterfront location. The project
will also restore much of the exterior facade of the Waterworks
Complex. The limited availability of land at the site will require
the removal of the filter house and parts of another building
within the complex in order to provide for on-site parking. In
addition, proposals to move the engineer's house to another site
will be solicited by the City.
If successful, this project will be a unique example of a
public/private partnership designed to reuse an existing historic
property. The City of Bangor will make a significant investment
toward project costa, an investment whichis ssary a
precondition to any private sector investment. Building
rehabilitation costs, the presence of hazardous materials, and site
limitations (such as the proximity of the railroad) contribute to
the high coat of redeveloping this site. Much of the City's
vestment will be supported through taxes which will be produced
bythe development and other project revenues. In return, the
private developer will make a major investment toward total project
costa which are estimated to be approximately $2.3 million and
create a projected 100 jobs.
