Subject: Amendment to a Lease Agreement with the Philtrum
Corporation
Issue
The Philtrum Corporation wishes to extend the lease agreement
between the City of Bangor and the Philtrum Corporation for use
of Building 9270 at 49 Florida Avenue, Bangor.
Background
The Philtrum Corporation has Enron leasing Building 9270, at 49
Florida Avenue since 1986 for use
office facilities. The
most recent lease was for three "are expiring on May 31, 1994.
The lease rate during the last year was $1,980 per month or
$5.50 per sq. ft. with the Lessee paying all utilities except
water and seargar user fees. The proposed amendment would make
the Philtruer Corporation responsible for all utilities including
water and sewer user fees.
Following are the substantive changes to the lease agreement: -
1. Extension of the term'for three years, until 1997.
2. Maintenance of the lease rate over the next two years and
increasing it by 4.58 in 1996.
3. Including water and sewer user fees as utilities for which
the lessee is responsible.
The Philtrum Corporation has accepted the following lease rates
and conditional

a. Building #270, approximately 4,320 sq. ft., located at 49
Florida Avenue, and the land appurtenant thereto.

use the driveway separating Building #273 and
Building
#270 jointly with the occupants of Building #272.

Utilitieas
Philtrum Corporation shall pay the coat of all
utilities furnished to or consumed on the
premises, including electricity, fuel oil, gas,
and water and sewer user fees.
Maintenance:
Me City of Bangor will be responsible for
maintenance of the buildings: foundation, roof,
structural walls, operating systema, including
heating, plumbing, and electrical systems except
fixtures, exterior doors, exterior windows and

parking areas.
Philtrum Corporation will be responsible for
building fixtures, floor and floor coverings,
ceilings, interior walls, and other interior paint
surfaces in the demised premises. The Philtrum
Corporation will also provide rubbish removal,
snowplowing and landscaping.
Taxes:
Any taxes imposed upon the real estate, building
and personal property
are the responsibility of
the Philtrum Corporation.
Insurance:
Philtrum Corporation will provide comprehensive
public and property damage liability insurance to
limits of $3000000 per each occurrence.

BanAfr Corporation and staff recommend approval of this lease
agreement under the terms and conditions outlined above.
