II, Bangor City Council -- Term Limitation for City Council Members

The attached item, if ultimately adopted by the City voters, would
amend the current City Charter provision imposing term limits on
City Council members. The Charter currently limits Council service
to two consecutive terms, but does not limit the number of
non-consecutive terms. The attached item would limit Council
service to a maxinumn of four three-year terms (12 years total),
consecutive or otherwise. If approved by the Council, this item
will need to be advertised for a public hearing to take place at
least 30 days prior to the November &h election date. - Final
Council approval must occur within s..ren (7) days after the public
hearing.

Thereafter at each annual municipal election there shall be chosen
at large three members of the City Council to hold office for a
term of three years. No voter shall vote for more than three.
Each member of the City Council shall hold office until his
successor is elected and qualified. members of the City Council
shall receive the sum of $400.00 per year in full compensation,
same payable quarterly. Unless City Council shall by ordinance
increase the amount members shall be entitled to receive as
compensation, provided, however, no such ordinance increasing the
Council's compensation shall take effect until approved by the
voters at a public referendum and until three (3) years after the
date of adoption by the Council. No person may serve as a member
of the City Council for more than twe-f2j four (4) complete
shall, during the term for which he or she shall have been elects
and for one year thereafter, be appointed to any other nonelected
office of profit or employment position of the City.

ORDERED, THATpursuant to 30-A M.R.S.A. 5 2104(6) and 2105(2),
the form of the question to be submitted to the voters
shall be as follows:

approved and adopted by the City of Bangor?"

consistent with this Order.

ORDERED;
THAT
WHEREAS, the Bangor City Charter currently limits members of the
City Council to two consecutive three-year terms, but
does not limit the number of non-consecutive terms; and
WHEREAS, it is the sense of the City Council that the present
term limitation provision should be modified to permit
Council members to serve for a total of four (4)
complete three-year terms, whether or not consecutive;
NOW, THEREFORE, By the City Council of the City of Bangor, be it
ORDERED, THAT the following amendment to Article II, Section 2 of
the Bangor City Charter be placed on the ballot of the
ext regular municipal election, to be held on November
- B, 1994, for approval by the qualified voters of the
City of Bangor inccordance with Title 30-A M.R.S.A.
Sections 2104(1) and 2105:
ARTICLE II
CITY COUNCIL
**Sec. 2. Composition, election, tenure of office, etc. There
shall be elected at large from the qualified voters in said city a
City Council consisting of nine members. At the first election
under the act there shall be elected nine members of said City
Council. No voter shall vote for more than nine. The three
candidates receiving the largest number of votes at said election
shall hold -office for three years, the three receiving the next
largest number of votes shall hold office for two years, the three
receiving the next largest number of votes shall hold office for
one year.
