Commentary:
The Planning Board held a publio nearing on the above -noted zone change at
its regularly scheduled meeting of Scaly, 5, 1994.
Steve Bolduc, Economic Development Officer, spoke in favor of the Proposed
change. Donald Sanborn, a neighboring property owner, had questions about
the proposed change.
No one spoke in opposition.
The Plawning Board voted 5 in favor and 0 opposed to a motion to recommend
to me City Council that the zme change request contained in C.O. M 94-299
be approved.

THAT the zoning boundary lines a established by the Zoning Map
of the City of Bangor dated October 28, 1991, as amended, be
hereby further amended as follows:
By changing parts of parcels of land located an Maine Avenue
between Florida Avenue and Illinois Avenue (Assessors Map No. 1,
Parcel No. 18 and Assessors Map No. R -25r Parts of Parcel No. 1)
from Industry and Service District to Urban Industry District and
from Industry and Service District to Airport Development
District. Said parts of parcels containing approximately 33.5
acres and being more particularly indicated on the maps attached
heretoand made a part hereof.

Item No. 5: Zone Change - Mein Avenue Between Florida Avenue
and Illinois Avenue - City of Bangor - C.O. t 94-

a. General Description. As a follow-up t0 the recent
discussion as to the appropriateness of different types of
industrial zoning on built-up areas on the Airport, the City
has reviewed the area around the General Electric site to
see what would be appropriate for inclusion in further Urban
Industrial District zoning (as opposed to Industry and
Service). The application before you includes in excess
of
33 a of Airport property owned by the City which would
be changed from industry and Service to Urban Industrial
District and, a small piece, to Airport Development
District.
b. Land Use and zoning Policy. The proposed parcels are
located amongst Airport Development District zoning
Goverment and Institutional Service District zoning and
Industry and Service zoning. As noted in our discussion of
the previous change of the GB site the present I 6 S zoning
is inappropriate for certain types of uses and difficult to
apply on previously built-up sites due to site
nonconformities, etc.. The area in question has a
reservation fors railroad siding which previously extended
all the way to the tank farm between Maine Avenue and Union
Street and contains the tank farm itself. The tank farm is
a permitted use in the UID Zone only and should have been
zoned that way originally, while access to rail sidings is
only permitted in UID zoned districts as well. (That is,
permission to build a loading dock or site a building
immediately adjacent to a rail siding for ease of loading
and unloading is only permitted in that district.)
C. Urban Services. Obviously, all these parcels are well
serviced and are within the Primary Service Area in this
area of the City.
d. Existing Conditions. Currently, these sites are occupied by
pre-existing site developments. The parcel next to Union
Street as noted above have a tank farm on it for jet fuel
and other aeronautical gas. There is a cluster of buildings
in the area between Florida Avenue and the City's Public
Works parcel off Maine Avenue. The former steam plant
structure is located on the corner of the Johnson
Avenue/Maine Avenue parcel (most of which had already been
rezoned UID - the GE site). There are existing buildings in
the Johnson Street/Florida Avenue/Maine Avenue/Hayes block.
The railroad siding and a number of pre-existing buildings
and site improvements exist around the parcel further down
Maine Avenue. (The reason that part of this site is

proposed for Airport Development District is because it is
contemplated that the reuse of this site will be limited to
the area between Maine Avenue and the railroad right-of-way
leaving what would be a landlocked piece of I s S zoning
which is more appropriately zoned with the abutting Airport
Development District properties).
e. Recommendation. The basic criteria for zoning is that it be
consistent with the City's Comprehensive Plan and is
consistent with existing zoning and uses in the area. The
Comprehensive Plan's zoning Policy Map indicates that most
of this area be reserved for the Airport Development
District. In this case, the proposed zone change from I S S
to UID and ADD is neither more nor less consistent with the
land use and zoning policy of the Comprehensive Plan. The
basis for the proposal is that the change to DID i
consistent with the Industrial zoning in the area and i

more appropriate industrial zone for these uses and these
site developments. Staff would recommend that the Planning
Board recommend the proposed zone change to the City
Council.
