Sections 20.3 through 20.5 of the Laws and Ordinances of City of Bangor, the charges and fees for the following services and situations are hereby set and may be assessed by the Superintendent of Banger's Publicly Owned Treatment Works: 1) Wastewater Discharge Permit Fee, which includes administrative processing of applications,eWing monitoring reports submitted by the discharger, randcost of inspection and collection of discharges - $250.00 per year. 2) Cost of analyzing the discharge of a wastewater discharge permit applicant or holder - The discharger will pay the actual lab costs for analyzing the particular sample whether billed directly by the lab or by, the City. 3) Administrative Appeal Filing Fee - $100.00. 4) Surcharges Fee for Excessive Loading: Parameter A. BOD - $0.71 per pound B. TSS - $0.52 per pound C. Fats, oil or greases 0f whatever origin - $0.19 per pound 5) Surcharge fee for cost of treating flows of wastewater - $770.00 per million gallons. Sewer Rate Study Update 4. executive Session - Negotiations The purpose of this memorandum is to provide you with some background information on the above agenda items. As you are aware, the meeting will take place at 7:30 a.m. on Monday. June 13th in the Third Floor Conference Room at City Nall. 1. Sewer Ordinance Amendments - The Ordinance amendments have been proposed as part of ongoing efforts to administer the City's Industrial Pretreatment Program. These technical amendments to the definitions of excessive Loading and Normal Domestic Sewage are necessary to set an upper limit of oil and grease concentration within those definitions. The reason for this action is in part due to increases in the amount of oil and grease being observed in the City's wastewater. For example, the City recently removed 2 1/2 tons of oil and grease from the A -Mart Pump Station in the Mall area. Staff is working to identify the source of this oil and grease, and this Ordinance change will aid in future enforcement action, if necessary. A related issue, and one that should save money for permit holders due to decreased sampling costs, is a administrative wising of the local limit level of concentration entration for oil and grease to 200 mg/1 to correspond to the prohibited discharge level. One of the permit holders has had a difficult time meeting the current 100 mg/l level which has re sulted in additional lab Costs for each reading above 100 mg/l.The new local limit level, which has been approved by the NPA, should reduce these coats, as well as the Pretreatment Coordinator's administrative costs. Staff would recommend approval of these technical amendments to the Ordinance. 2. Pretreatment Fees - As you are aware, the new Treatment Plant has been running and meeting permit requirements for over a year. The Ordinance amendments passed on November 22, 1993 authorised the setting of various fees by Council Order to cover the administrative expenses of the Plant's Pretreatment Program. The NPA requires the City to take steps to cover the costs of the Pretreatment Program. 94-286 -2- Treatment Plant staff have been able to calculate the coat of certain services and situations that may arise during the administration of the Pretreatment Program. Some of these, such as the surcharges a based on the actual cost to the City for treating excessive loadings or excess flows based on a year of Plant operating cost data. These surcharges may have to be adjusted in the future depending on the Plant's then current operating costs. The appeal fee covers the costs of organizing, including notification of abutters, an administrative appeal and is the same as filing an appeal of a Court action. The permit fee includes approximately $100 for processing the application, with the remainder assessed to monitoring permit holders and collecting samples. Lab costs for analyzing samples have always been handled in this manner. The permit fee is one that staff felt the current permit holders c absorb while at the same time making an attempt to cover the City's costs. This Order requires commendation fox action at the June 13th Council Meeting as all permit holders are in the process of applying for new permits. Thus, authorization is needed for the permit fee being assessed. Staff would recommend your approval. 3. Sewer Rate Study Ucdate - CH2 -Hill has provided a draft of the Stormwater Utility part of the sewer rate study. Staff will be prepared to give a brief summary of staff's thoughts or comments on the draft. CH2M-Hill will address these comments, together with earlier comments on the first part of the Sewer Rate Study, in the Final Report. 4.
