Item/Subject. Lease Amendment with Maine National Guard for the
Bangor Armory

Commentary:
The lease for the Bangor Armory which resulted from the swap of
178 acres with the Guard expires on December 31, 1989. The cur-
rent lease is for $1.00. The Guard has requested a lease ex—
tension until June of 1992. The proposed rent would be $1.00
annually. The Guard will vacate the property on 30 days notice
for the land and 60 days notice for the building, if we need
the property back. They will continue to maintain the property
during the term of the extension. This item has been presented
to Coamunity and economic Development on 12/19/89.

amendment with Maine Department of Defense (National Guard) for the

AMENDMENT NO. 1 TO
INDENTURE AP LEASE

THIS AMENDMENT, executed in duplicate, this 28th day of December,
1989, by and between:
CITY OF BANGOR, a body politic and corporate, duly
organized and existing under and by virtue of the
laws of the State of Maine, and being located in
the County of Penobscot, State of Maine (hereinafter -
sometimes referred to as 'Lessor")
AND
STATE OF MAINE, acting by and through the State of
Maine, Department of Defense, of Augusta, County of
Kennebec, State of Maine (hereinafter sometimes
referred to a "Lessee")
W I T N E S S E T U:
WHEREAS, by Indenture of Lease dated October 7, 1987, the parties
agreed to the lease by the Lessor of a parcel of land, together with all
buildings thereon known as the Bangor Armory; and
WHEREAS, the parties hereto wish to amend said Indenture of Leese to
permit Lessee to continue leasing Armory Building and Land appurtenant
thereto, and the remainder of the parcel as further described.
NOW, THEREFORE, the parties do mutually agree as followai -
(1) THAT, Article 1 be deleted in its entirety and replaced with
the following: _
1. PREMISES. The Lessor, for and in consideration of the
ants to be paid and the obligations to be performed by
.Leasee as hereinafter provided, does hereby rent unto Lessee,
the following described property in its present condition,
via:
Parcel A: Armory Building. 2 acres more or less
appurtenant to; and
Parcel B: Remainder of the land, 2.7 acres more
or lose
as further shown on Exhibit A attached.
(2) THAT, Article 2 be deleted in its entirety and replaced with
..the following:

2. TERM AND RENTAL. TO HAVE AND TO NOLO the above-described
premises as follows:
Parcel A for a term starting on January 1, 1990 and expiring
on June 30, 1992.
Parcel B for a term starting on January 1, 1990 and expiring
on June 30, 1992.
To have and to hold the above described premises unto Leasee
at an annual rental of $1.00. -
The Lessor shall have the right to request the Lessee to vacate
Parcel A upon 60 days written notice to the Lessee.
The Lessor shall have the right to request the lessee to vacate
Parcel B upon 30 days written notice to the Lessee.
137 THAT, except for the foregoing, said Indenture of Lease, dated
October 7, 1987 between the City of Bangor and the State of Maine shall
remain n full force and effect in all other respects between the
undersigned.
IN WITNESS WHEREOF, the parties hereto have set their hands and
seals the day and year first written above.
