Item/Subject: Amending Chapter VIII of the Ordinances of the City

Commentary:
The attached amendment to the City's Zoning Ordinance i
intended to bring the City of Bangor into compliance with
the State of Maine's manufactured housing law, as amended
May 9, 1989, by the Legislature.
See Cover Sheet for "Amending Chapter %I of the Ordinances of
the City of Bangor -- Mobile Home Ordinance" for further
explanation.
Staff of both Planning and Legal have reviewed these
amendments and recommend their adoption.V

The Planning Board held a public hearing on the above zoning
amendment at its regularly scheduled meeting on January 16, 1990.
No one spoke in opposition to the proposed zoning amendment.
The Planning Board voted five in favor and none opposed to
recommend to the City -CcI=oil that C.O. i 90-29 be approved.

(1) THAT Chapter VIII, Article 3, Section 2 of the Laws and
Ordinancee of the City of Bangor be amended to read in part, as
follows:
Mobile Home Park: A parcel of land planned and improved
for the placement of three e3) ore
mobile homes for non -transient use as licensed under the
Mobile Home Ordinance;
(2) THAT Chapter VIII, Article 5, Section 2(3)(2) of the Laws
Fand Ordinances of the City of Bangor be emended to read in part,
as follows:
(k) reconstruction of existing mobile home ,parks . .

Ordinances of the City of Bangor be amended to read in part, as
follower

the first 3 dwelling units; for each

Ordinances of the City of Bangor be amended to read in part, as

the first 3 dwelling units; for each
additional dwelling unit adds 800 sq. ft.

a. The proposed amendments contained in C.O. k 90-29 are
rtiof-
fered as a result of a amendment to State Statutes passed
by the last session of the legislature. This statute man-
dates
that mpbilehome parks be defined i certain way (it
is a place for placement of three or more mobilehomes); and
that there be nominimum srall let size for mpbilehome

C. The city really has little choice but to amend its ordinanc-

in this way at thitime and Staff would recommend that
the Planning Board recommend the amendments contained in
C.O. k90-29 to the City Council.
