ORDERED,
THAT Chapter II. Article 21 of the Ordinances of the City of
Bangor are hereby amended by adding the following:
5.13 AMOUNT OF ASSISTANCE. The basis of eligibility for ass ist-
once from the Bangor Welfare Department is that the applicant/
applicants have a need under the Standard Of Need Deficit Such
determination shall be made by use of an indigence formula.
Eligibility under all other emergency provisions shall be determined
by'these regulations and the c record shall specify the section
under wbicM assistance is provided.
Notwithstanding the above sections it is not intended that the
Bangor Welfare program be other than to satisfy the specific emer-
gency need Of a recipient for a specified period at time.
Assistance granted will be on the basis that there is no available
resource.
Verification of income and expenditure will be required to establish
that there is no available resource and the caseworker may authorize
gsistant€ up to the limits established under the indigency formula

FOOD. Vouchers may be issued to purchase necessary food. Such
vouchers may be issued in any amount not exceeding the weekly food
allowance stated in these Guidelines. Such vouchers are

ucherl, candy, potato chips, and similar snack items, beer, wine
and novelty items. -

5.13. MOM OF ASSISTANCE — updates food levels to current Thrifty Food
Plan as required. Updates rent maximums to N.U.D. levels as required.
Changes the per person standard to a per bedroom standard as outlined
by H.U.D. and clarifies the number of bedrooms allowable. Clarifies
the policy for paying rent to as outlined in the
latest statute revision.
5.14.F. HOSPITALTZATIOR — clarifies the procedure for dealing with hospital
bills.
5.14.J. BURIAL — adjusts Sees to those recommended by M.M.A.

HOUSEHOLD/PERSONAL. Vouchers may be issued to purchase household
and personal itemsincluding, but not limited to broomssoap,
detergent toilet paper, toothpaste, disposable diapers, etc.
Personal care items shall not include Cosmetics.
HOUSING. It is the individual client's responsibility t0 find ade-
quate housing, except in cases of emergency, when the caseworker
may help arrange temporary shelter.
The Welfare Department will not become involved in the landlord/
tenant or mortgage

to obtain housingthat will be within hisrher ability to pay before
further housing assistance will be rendered.
When the caseworker determines that it will be necessary to give
funds to meet any or all of a client's housing payment the amount
will be actual rent/mortgage paid by the client, if the amount to
be paid is reasonable and in accordance with limitations set into
these guidelines.

The total amount paid for rent/mortgage, fuel and utilities will
not exceed the maximum household limits set forth in Section 5.12.
That the Provisions of Chapter II, Article 21, Section 5.100 of
the Laws and Ordinances of the City of Bangor be repealed and re-
placed with the following!
5.10D. TANGIBLE ASSETS. No person owning or possessing tangible
sets consisting of more than one motor
vehicle, or a boat, trailer, recreation vehicle or other
assets that are convertible into cash and a -essential
to the maintenance of the applicant's household will be
eligible for general asistance. Exceptions may be made
when a person i making ainitial application and when
reasonable efforts to convert assets to cash at fair market
value are unsuccessful.
Tools of a trade and other equipment used for the
production of income are not considered available
assets.
a. The ownership of o automobile under the value
of $4,500 by an applicant or a dependent will not
make the applicant ineligible for assistance if
such automobile is essential for transportation to
employment, medical care, rehabilitation or training
facilities.

replaced with the following:
5.10E. CITIZENSHIP. Applicants who are
either citizens of the
United States nor lawfully admitted clients
will be referred to the United States Department of Immi-
gration for appropriate action. Emergency assistance may

be granted to a applicant pending action by the Department
of Immigration.

5/10H. REAL PROPERTY. No person Owing real property shall be
eligible for assistance except as follows:
a. where the applicant owns real property in which he/she
makes his/her home he/she may be eligible to receive
assistance.
b. When the City spends general asistance funds to
provide mortgage payments to an eligible person, such
payments may notexceed the housing maximums stated
n these guidelines. A lien may be placed upon that
property for the amount of mortgage assistance given.
Such a lien will not be claimed until the death of
the recipient or the transfer of said property. Any
recipeint receiving assistance with a mortgage payment
will receive written notification of these conditions.
C. The Welfare Department may provide assistance upon re-
ceipt
e-ceipt of the initital application to persons owning
real estate other than their home in cases of emergency.
Continued eligibility for any type of assistance will
depend upon the applicant making a reasonable effort
to dispose of such real property at a fair market value.
That the provisions of Chapter I1, Article 21, Section 5.10K of the
Laws and Ordinances of the City of Bangor be repealed and replaced
with the following:
5.10R SECURITY DEPOSITS --BACK BILLS. It is the policy of the
City of Bangor not to
expend public funds for security deposits. When the only
suitable housing available requires a security deposit the
client will be required to enter into an agreement with the
landlord to pay a portion of the deposit each month until
the total payment is made or to apply for whatever other
resources might be available to assist in the payment of
security deposits. When no other solution is possible,
the caseworker may issue a written guarantee for damages
(in lieu of up to one month's rent).
Assistance is not available to pay a bill for a basic
necessity when that bill is more than 2 months old and
the person requesting assistance had sufficient income,

utilities.

Single individuals will be required to live in rooming or
boarding houses when such housing is available.
Applicants requesting assistance for housing that contains more
bedrooms than are necessaryfor the number of household members
will be provided assistance according to the maximum level for
the number of bedrooms actually needed.
Payments for rental assistance on behalf of an otherwise eligible
individual will not be made to a parent or grandparent, by con-
sanguinity, unless the rental arrangement has existed for three
(3) months prior to the application for assistance and is
necessary to provide the parent or grandparent with basic
necessities.
MISCELLANEOUS: Medical, dental and eye services may be pro-
vided o emergency basis. Except in
unique situations approved by the Director, the Caseworker
will not approve dental expenses other than tooth extractions.
That the provisions of Chapter II, Article 21, Section 5.14F
of the Laws and Ordinances of the City of Bangor be repealed
and replaced with the following:
5.14F HOSPITALIZATION. In the event of a ergency admis-
sion to the hospital, the hospital
must notify the Director within 5 business days of the
admission. Notification must be by telephone, confirmed
by certified mail, or by certified mail only. If a
hospital fails to give timely notice to the Director
the City of Bangor will have no obligation to pay the
bill.
Any person who cannot pay his/her hospital bill must
apply to the hospital for consideration under the
hospital's charity care program as provided in Title
22 M.R.S.A. 4 396-F(1). Anyone who is not eligible
for the hospital's charity care program may apply for
general assistance. Applicants must apply for assistance
within 30 days of being discharged from the hospital
and provide a notice from the hospital certifying that
they are not eligible for the hospital's charity care
program.
Before the City of Bangor will consider whether an ap-
plicant is eligible for assistance with a hospital bill,
the applicant must enter into aenable payment ar-
rangement
-rangement with the hospital. The payment arrangement
will be based upon the Medicaid rate for services ren-
dered. in determining an applicant's eligibility the
caseworker will consider the monthly payment to the
hospital the applicant has agreed to pay as a necessary
expense.

Chapter II, Article 21, Section 5.14J
or the Laws and Ordinances of the City of Bangor be repealed
and replaced with the following:
5.14J BURIAL. The Welfare Department shall provide for
proper burial of indigent persons providing
that the total burial costs do not exceed $1,000 and
it is determined that the burial costs cannot be paid in

total, or in part, from any other s including re-
sponsible relatives or from the estate of the deceased.
The Welfare Department will apply all monies available
from other sources towardthe total burial costs. The
allowance for burials under these guidelines shall in-
clude

clude the undertaker's services, clergy, personal at-
tendants, casket, vault box, hearse and obituary. When
required, a maximum of $200 may be paid for a liner_ The
expense of opening and closing thegrave will be considered
an additional cost to be paid directly to the cemetery up
to amaximum
of $150. The additional cost of a graveside
service will not be considered a covered expense
under
these guidelines. The Welfare Department will not pay for
transportation for burials in lots outside of the City..
Any person qualifying for assistance under this section may
be. buried in a lot provided by the City for such purposes.
The Welfare Department will not be obliged to pay for any
burial expenses provided if the Director has not approved
such expenses prior to their delivery.
