James Dufour, Esq. representing the applicant, spoke in favor of th
'application.
The Planning Board voted 5 to 0 in favor of a motion to approve
the revised subdivision plan.
Note: The proposed subdivision is subject to the execution of an
agreement between the City and the applicant concerning the
proposed private street.

THAT the final subdivision plan for a developmental subdivision
located at 232V Stillwater Avenue and consisting of 48 units, having been
reviewed by the Planning Board and found to be in general conformance
with local subdivision laws and State of Maine Statutes, title 30, Section
4956, be approved. No public improvements are proposed, therefore, no
bond required.
AND BE IT FURTHER. ORDERED THAT, the City Manager be hereby
authorized to execute a Road Agreement between the City of Bangor and
Sheldon L. Hartstone, a copy of which being on file in the City Clerk's
Office.

Item No. 4: Final Subdivision Plan Approve] - 323 Stillwater
Avenue - Sheldon Hartstone.
a. Applicant requests final plan for a 48 unit developmental
subdivision located of£ Stillwater Avenue in a contract
Residential 5 Zone.
b. The Proposed revision entails arevision to the number of
nits in the project. The Board Previously approved the
site plan and preliminary subdivision plan increasxnq the
umber of units from 40 to 4S at the November 6, 1989 meet-
ing. The final plan is identical to the previously approved
preliminary plan.
C. The Board may recall lengthy discussion as to the design of
the private roadway and the number of units Which it could
serve. The parties Involved have reached agreement on the
right-of-way width at 28 feet with a travel way of 24 feet.
The Planning Staff would find the proposed revision adequate
to handle the 48 units planned to the rear and the 64 units
Proposed on the front of the site.
d. The finalplan before the Board indicates 48 units antl the
revised roadway. Staff would recommend final plan approval
with the condition that anagreement on the construction antl
maintenance be acceptable to the City Solicitor and filed
with the Planning Office.
